RESOLUTION NO. 573g
.v1 _: ,AS, a certain building has heretofore been
erected under a permit issued by the City of Miami Beach upon
Lots 7 and 8 of Block 11,
OCEAN BEACH ADDITION NO. 1,
according to the Flat thereof,
recorded in slat Book 3, at
page 11 of the Public Records
of Dade County, Florida,
and
WriERLAS, a recent survey reveals that said building
encroaches 0.07 feet on Ocean Drive and encroaches 0.12 feet on
the alley adjacent to said property on the West thereof, copy
of the engineer' s certificate and sketch of survey being hereto
attached; and
WHEREAS, it is the opinion of the City Council that the
encroachment was unintentional,
N0 , THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that so far as said Council has
the power to bind the City of Miami Beach in the premises, no
action of any kind whatsoever shall be taken by said City to re-
quire the owners of said property, their heirs, successors or
assigns, to move or remove the structure located on said land by
reason of said encroachments.
PASSED and ADOPTED this 7th day ofJu.ne, A. D. 1944.
