a certain building has heretofore been
erected upon Lot 12, and the North thirty-five (35) feet of
Lot 11, Llock 16, OCEAN BEACH ADDITION t2, according to the
Plat thereof, recorded in Flat Book 2, at pave 56, of the
•Public Records of Dade County, Florida; and
WHEREAS, a recent survey reveals that the said build-
ing encroaches upon the alley adjacent to said property on
the .past thereof, said encroachment varying in extent from a
distance of 0.07 feet at the North end of said Lot 12, to a
distance of 0.05 feet at the North end of said Lot 11; and
WHEREAS, it is the opinion of the City Council that
the said encroachment was unintentional,
NOW, T EREFORE, BE IT RESOLVED BY THE CITY COUNCIL of
the city of Miami Beach, Florida, that so far as said Council
has the power to bind the City of r iami Beach in the premises ,
no action of any kind whatsoever shall be taken by said City
to require the owners of said property, their heirs, successors
or assigns, to move , or remove, the structures located on said
land by reason of said encroachment.

Addition No 2 according to plat thereof recorded in platb book 2 at
page 56 of the public records of Dade County, Fla. That the corners of
the above described pro_ierty have been marked with iron pipe as shown.
That the building located on the above described property satnd within
the title lines thereof EXCEPT that it encroaches on the alley as
shown. The concrete awning on the East sidec of the building also
encroaches on the alley as shown. There are no other encroachments.
There are no encroachments on this property by any other structure.
