Resolution 5774 RESOLUTION NO. 5774
WHEREAS, City of Miami Beach has heretofore, to-wit : on the
14th day of August , A. D. 1944, entered into an agreement with Sea-
Bay Corporation, a Florida Corporation, by the terms of which said
agreement said City agreed to purchase from said Sea-Bay Corporation,
the following described property situate in Dade County, Florida, to-
wit :

Lot "A" of Di Lido, an Island in
Biscayne Bay, according to the Plat
thereof, recorded in Ph t Book 8,
at page 36, of the Public Records
of Dade County, Florida, also an
eight foot strip of land contiguous
to the Northern Boundary line of
said Lot "A", lying between the
Northerly extension of the Easterly
and Westerly Boundary lines of said
Lot "A";
and
WHEREAS, said agreement provided that said City should be
obligated to purchase the said property only in the event that per-
mits be secured from the United States War Department for filling
in and upon, and bulkheading about, a tract of submerged land in
Biscayne Bay, lying North of Di Lido Island, and to construct a
bridge to connect the said filled lands with Di Lido Island; and
WHEREAS, said City has secured said permits from the United
States War Department ; and
WHEREAS, the City Attorney has approved the title to said
lands,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the City Manager be and he is
hereby authorized and directed to consummate, for and on behalf
of said City, the purchase of the above-described property, on the
terms set forth in said agreement .
BE IT FURTHER RESOLVED that the City Manager, and the City
Clerk, be and they are hereby authorized and directed to make all
payments required by said agreement out of funds available for the
purpose.
