Resolution 5790 RESOLUTION NO. 5790
WHEREAS, under date of June 5th, 1942, the City of Miami Beach,
as Lessor, entered into a lease with the United States of Amei ca,
as Lessee, said lease being known as W-2287 Eng.-1182, and covering
the following described parcel of land situate in Miami Beach, Dade
County, Florida, to-wit.:
That portion of Flamingo Park described as
follows : Beginning at the Southwest corner
of Lot 5, Block 70 of the LINCOLN SUBDIVISION,
in the City of Miami Beach, County of Dade,
State of Florida, according to plat thereof,
recorded in Plat Book 9, page 69 of the Public
Records of said Dade County; thence running
south a distance of 195.7 feet ; thence easterly
a distance of 340.2 feet ; thence northerly a
distance of 195.7t ; thence westerly a distance
of 340.3 feet to the point or place of begin-
ning;
and
WHEREAS, under date of October 7th, 1942, said City of Miami
Beach, as Lessor, and said United States of America, as Lessee, entered
into a lease known as W-2287 Eng.-1883, and covering certain parcels
of land described in said lease and delineated upon a sketch thereto
attached, among said parcels being a tract containing approximately
five acres and shown and cross-hatched on said sketch as lying North
of the "Volley Ball Courts" and East of the fence along the Easterly
Side of the Baseball Field ; and
WHEREAS, the United States of America is now in possession of
said lands and has been requested to grant its consent to the use of
said two parcels of land above described on March 18th, 1945, for the
purpose of presenting a Horse Show for the benefit of the Community
War Chest ; 'and
WHEREAS, the United States of America has indicated that said
permission will be granted, provided the City of Miami Beach will re-
lease said United States of America from liability in connection with
said use of said parcels of land.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Miami Beach, Florida, that the United States of America be and it
is hereby released and freed from any and all liability or obligation
on account of, or in connection with, any injury or damage to any
property or to any person or persons resulting from or incidental to
the use of said parcels of land for the purposes hereinabove stated.
