RESOLUTION NO. 6072
WHEREAS, a certain building has heretofore been erected
upon that certain parcel of land situate in the City of Miami Beach,
Florida, described as follows, to-wit:
Lots 1, 2, 3, 4, 5 and 6 of Block 25 of OCEAN BlACH
ADDITION NO. 3, according to the Plat thereof, re-
corded in Plat Book 2, at pa7,e 81, of the Public
Records of Dade County, Florida, said property being
known as "Blackstone Hotel Property" ; and
',vilERFAS, a recent survey made by Zurwelle-Vdhittaker, Inc. ,
reveals that the said building encroaches upon 8th Street and also
upon Pennsylvania Avenue, both being public streets of the City of
Miami Beach, Florida, and
WHEREAS, it is the opinion of the City Council that the said
encroachment was unintentional,
NOW, TI Ea ORE, BE IT RiSOLVED by the City Council of the
City of Miami Beach, Florida, that insofar as said Council has the
power to bind the City of Miami Beach in the premises, no action of
any kind whatsoever shall be taken by the said City to require the
owners of the said property and their heirs, successors and assigns
to move, or remove, the portion of structures encroaching upon said
public streets as aforesaid.
PASSED and ADOPTED this 17th clay of July, A. D. 1946.
