Resolution 6207 RESOLUTION NO. 6207 RESOLUTION CLOSING TO USE FOR HIGHWAY PURPOSES THAT PART OF LENOX AVENUE LYING SOUTH OF FOURTH STREET AND NORTH OF ALTON ROAD. WHEREAS, The Board of Public Instruction of Dade County, Florida, has acquired title in fee thereto of all lands lying both east and west of and bounding that portion of Lenox Ave- nue lying south of 4th Street and north of Alton Road and said part and portion of Lenox Avenue being more particularly de- scribed as beginning at the northeast corner of Block 102 of Ocean Beach Addition No. 3, as the same is shown in Plat Book 2, at page 81, of the Public Records of Dade County, Florida; thence east 70 feet to the northwest corner of Block 100 of said Ocean Beach Addition No. 3, as shown on the plat afore- said; thence south along the west line of said Block 100 to the intersection thereof with the northeasterly line of Alton Road; thence northwesterly along the northeasterly line of said Alton Road projected to the most southerly point of the aforesaid Block 102 of Ocean Beach Addition No. 3, which is the intersection of said northeasterly line of Alton Road with the west line of Lenox Avenue, as shown upon the aforesaid plat, thence north along the east line of said Block 102 to the point of beginning; and WHEREAS, at or about the time of the acquisition of said lands so lying east and west of the above described portion of Lenox Avenue, the City of Uiami Beach, as evidenced by the minutes of meetings, respectively, on March 4, 1936, and March 18, 1936, ex- pressed its willingness and intentions to invest said The Board of Public Instruction of Dade County, Florida, with all the right, title and interest of said City in and to the above described portion of Lenox Avenue and to close the same to public use for highway purposes; and - 1 - WHEREAS, said The Board of Public Instruction of Dade County, Florida, acting pursuant to the authority and intentions so expressed and under color of other deeds and muniments of title of record, went into and assumed ownership, dominion and possession of said above described portion of Lenox Avenue and does now hold, and at all times since has held, possessed and utilized the same as a part of South Beach Elementary School site; and WHEREAS, the City now desiring to vest the title, use and ownership of said above described portion of Lenox Avenue in said The Board of Public Instruction of Dade County, Florida, insofar as it properly and lawfully may do; NOW, THEREFORE, BE IT RESOLVED that the portion of Lenox Avenue as hereinabove particularly described be and the same hereby is declared closed to public use for highway purposes and that all right, title and interest of the City of Miami Beach, Florida, that lawfully may be conveyed be and the same is hereby con- veyed to said The Board of Public Instruction of Dade County, Florida, for school purposes.
