Resolution 6511 RESOLUTION N0. 6511
WHEREAS, a certain building has heretofore been erected
upon that certain parcel of land situate in the City of Miami
Beach, Florida, described as follows , to-wit:
Lots 1 and 2 of Block 64 of
OCEAN BEACH ADDITION NO. 3,
according to the Plat thereof,
recorded in Plat Book 2, at
page 81, of the Public Records
of Dade County, Florida;
and
WHEREAS, a recent survey made by Richard F. Giersch, Jr. ,
Registered Engineer, reveals that the said building encroaches
upon 13th Street and upon Euclid Avenue, both being public
streets of the City of Miami Beach, Florida, copy of said survey
being hereto attached, and
WHEREAS, it is the opinion of the City Council that the
said encroachment was unintentional,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that insofar as said Council has
the power to bind the City of Miami Beach in the premises, no
action of any kind whatsoever shall be taken by the said City to
require the owners of the said property and their heirs, successors
and assigns to move, or remove, the portion of structures encroach-
ing upon said public streets as aforesaid.
PASSED and ADOPTED this 28th day of January, A. D. 1948.
