Whereas a certain building has heretofore been erected under
permits issued by the City of Miami Beach upon
The South 300 feet of Block 24, Ocean Beach,
Florida, addition #3 according to Plat there-
of filed for record and recorded in Plat Book
21, Page 81 of the public records of Dade
County, Florida; and
Whereas a survey prepared by Biscayne Engineering Company, Civil
Engineers of Miami, Florida, under date of September 13, 1937, a copy
of which sketch of survey and engineer' s certificate being hereto
attached, reveals that the building located on said property does not
encroach upon the sidewalks belonging to the City of Miami 13each, but
reveals that certain attachments upon said building do encroach as
follows:
a- Fire Escape encroaches 3. 98 feet above Pennsylvania Avenue.
b- Awnings, copings, eaves, balconies, fire escapes, water hydrant,
columns and downspouts encroach slightly over Pennsylvania Avenue
and Washington Avenue.
c- Fire escape encroaches 3.4 feet and 1.33 feet on Pennsylvania Ave-
nue.
d- Upper story porch encroaches 1.31 feet above Pennsylvania Avenue
and 1.22 feet over Washington Avenue.
Whereas it is the opinion of the City Council that the said en-
croachments were unintentional;
Now, Therefore, Be It Resolved by the City Council of the City
of Miami Beach, Florida, that no action of any kind whatsoever shall
be taken by the City of Miami Beach to require the owners of said
property, their heirs, successors or assigns, or persons, firms or
corporations claiming by, through or under them, to move or remove
the structure or structures located on said premises by reason of said
encroachments; and such owners are granted permission to maintain such
encroachments as they now exist until such buildings or structures are
destroyed or removed.
PASSED and ADOPTED this 7th day of July A. D. 1948.
