Resolution 6652 RESOLUTION NO. 6652 WHEREAS, by Resolution No. 6611, passed and adopted by the City Council of the City of Miami Beach, Florida, on July 15th, 1948, the City Manager was authorized and directed to purchase, in the name and on behalf of said City, the following described land situate, lying and being in the City of Miami Beach, Dade County, Florida, to-wit: A portion of Block Eighteen (18) of BISCAY?E POINT, and a portion of Lot One (1) of Block Twenty (20) of First Addition to BISCAYNE POINT, more particularly des- cribed as being approximately 155 feet on the canal and approximately 155 feet on Hawthorne Avenue, in the City of Miami Beach, Florida, said land being bounded on the South by 81st Street and on the East by Hawthorne Avenue, subject only to conditions, restrictions and limitations of record; zoning ordinances of the City of Miami Beach, Florida; and taxes for the year 19 +8 which are to be pro-rated as of the date of closing, and payment by the City of a commission in the amount of $375.00, and WHEREAS, it now appears that, by virtue of sanitary sewers, the construction of which has heretofore been authorized by said City Council but not yet performed, there are now "pending liens" against said property, and T.THEREAS, it is the custom in real estate transactions in said City for the purchaser to assume pending liens and for the seller to pay certified liens, and WHEREAS, the owner of said property has refused to pay off said pending liens or to deduct the amount thereof from the purchase price heretofore agreed upon, and WHEREAS, it is deemed to be for the best interest of said City to acquire said property subject to said pending liens and to pay therefor the purchase price heretofore agreed upon and set forth in said Resolution No. 6611 without requiring the seller to pay off said liens or to deduct the amount thereof from the purchase price, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the City Manager be and he is authorized and directed in the name of and on behalf of said City to purchase said property at the price and terms set forth in said Resolution No. 6611 without requiring the seller to pay off said pending liens or to deduct the amount thereof from said purchase price.
