Resolution 6433 RESOLUTION NO. 6433
WHEREAS, a certain building has heretofore been
erected upon that certain parcel of land situate in the
City of Miami Beach, Florida, described as follows, to-wit:
The North 100 feet of Block 24,
OCEAN BEACH ADDITION NO. 3 , according
to the Plat thereof, recored in
Plat Book 2, at page 81 of the Public
Records of Dade County, Florida.
WHEREAS, a recent survey made by Biscayne Engineering
Company reveals that the said building encroaches upon Wash-
ington Avenue and upon 8th Street, both being public streets
of the City of Miami Beach, Florida, copy of said survey being
hereto attached, and
?WHEREAS, it is the opinion of the City Council that
the said encroachment was unintentional,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that insofar as said Council
has the power to bind the City of Miami Beach in the premises?
no action of any kind whatsoever shall be taken by the said City
to require the owners of the said property and their heirs, suc-
cessors and assigns to move, or remove, the portion of struc-
tures encroaching upon said public streets as aforesaid.
PASSED and ADOPTED this 17th day of December, A. D.
1947.
