Resolution 6702 RESOLUTION NO. 6702
WHEREAS, on the 18th day of October, 1948, judgment was
entered in the Circuit Court of Dade County, Florida, against the
City of Miami Beach, Florida, for the sum of 4';90,333.33 and costs
in that certain cause therein lately pending, entitled GEORGE
FAIN versus CITY OF MIAMI BEACH on account of personal injuries
sustained by the said George Fain in the Flamingo Park Band Shell
on the night of July 12th, 1947, and
WHEREAS, the said George Fain, through his attorneys of
record, has agreed to accept the sum of °vii 7/, 5Qj2,j2V
in full satisfaction of said judgment, and
WHEREAS, the City Council of thg City of Miami Beach, Florida,
deems it to be to the best interest of the said City to make such
a settlement,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the said settlement be and the
same is hereby authorized and the Assistant City Manager and the
City Clerk be and they are hereby authorized and directed to pay
to George Fain and the attorneys of record for said George Fain,
the sum of $ 77, 6'00. 00 , in full satisfaction of said
judgment, out of funds of said City available for the purpose.
BE IT FURTHER RESOLVED that the sum of 4 7126-00, 00 be
and the same is hereby appropriated out of Current Fund Surplus
for the purpose aforesaid.
