Resolution 2018-30325 RESOLUTION 2018-30325 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, IN ACCORDANCE WITH FLORIDA STATUTES SECTION 376.80(4), APPOINTING THE SUSTAINABILITY AND RESILIENCY COMMITTEE AS THE ADVISORY COMMITTEE TO THE CITY'S TO THE BROWNFIELD REHABILITATION AND REDEVELOPMENT PROGRAM; FOR THE PURPOSE OF IMPROVING PUBLIC PARTICIPATION AND RECEIVING PUBLIC COMMENTS AS TO THE REHABILITATION AND REDEVELOPMENT, FUTURE LAND USE, LOCAL EMPLOYMENT OPPORTUNITIES, COMMUNITY SAFETY, AND ENVIRONMENTAL JUSTICE IN IMPLEMENTING THE BROWNFIELD DESIGNATION FOR THE FOUR CITY PARCELS KNOWN AS THE MIAMI BEACH CONVENTION CENTER, MAURICE GIBB MEMORIAL PARK GREEN REUSE AREA, THE FORMER PAR 3 GOLF COURSE, AND THE CITY'S FLEET MANAGEMENT MECHANICAL MAINTENANCE FACILITY. WHEREAS, Florida Statutes Section 376.79(4) defines a "Brownfield site as the real property, the expansion, redevelopment, or reuse of which may be complicated by actual or perceived environmental contamination; and WHEREAS, Florida Statute Section 376.79(3) defines a "Brownfield Area" as a contiguous area of one or more brownfield sites, some of which may not be contaminated, and which has been designated by a local government resolution as a Brownfield; and WHEREAS, Florida Statutes Section 376.77 — 376.85 create the process for a city to designate, by resolution, certain contiguous areas, consisting of one or more Brownfield Sites as Brownfields Areas, for the purpose of encouraging rehabilitation (including remediation), job creation, and economic redevelopment; and WHEREAS, the City of Miami Beach is designating four Brownfield Areas within the City limits for purposes of encouraging rehabilitation (including remediation), job creation, and economic redevelopment; and WHEREAS, these four proposed Brownfield Areas are: the Miami Beach Convention Center, Maurice Gibb Memorial Park Green Reuse Area, the Former Par 3 Golf Course, and the City's Fleet Management Mechanical Maintenance Facility (second reading of the public hearing designation resolution being held at the June 6, 2018 meeting); and WHEREAS, in designating a Brownfield Area, the Florida Legislature, pursuant to Florida Statutes Section 376.80(4), requires the City to establish an advisory committee, or, in the alternative, to use an existing advisory committee that has formally expressed its intent to address redevelopment of the identified Brownfield Areas, which committee would be responsible for obtaining public participation in the rehabilitation and redevelopment of the Brownfield Areas, and input into the future land use designation for the Brownfield Areas, and input into any local employment opportunities, community safety, and environmental justice concerns; and WHEREAS, the City of Miami Beach Sustainability and Resiliency Committee meets the criteria for the advisory committee set forth in the Florida Statutes and the City Administration recommends appointing the Sustainability and Resiliency Committee as the required advisory committee to the Brownfield Areas. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That the recitals and findings set forth in the whereas clauses to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth herein. SECTION 2. That the Sustainability and Resiliency Committee and incorporated herein by reference is hereby appointed as the Advisory Committee for the purposes set forth in Florida Statutes Section 376.80, for Brownfield Areas public input purposes.
