Resolution 2018-30333 RESOLUTION NO. 2018-30333 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, PURSUANT TO SECTION 82-93(a), OF THE CITY CODE, SETTING A PUBLIC HEARING TO CONSIDER APPROVING A REVOCABLE PERMIT REQUEST BY 1680 MICHIGAN CONDOMINIUM ASSOCIATION, IN ORDER TO ALLOW THE INSTALLATION OF AN ADDRESS SIGN AND DECORATIVE ALUMINUM CHANNELS ON THE FACADE OF 1680 MICHIGAN AVENUE, WHICH SIGN AND CHANNELS SHALL PROJECT APPROXIMATELY THREE INCHES (3") OVER THE PUBLIC RIGHT-OF-WAY, AND APPROXIMATELY 10 FEET TO 37 FEET ABOVE GRADE. WHEREAS, 1680 Michigan Condominium Association, (Applicant) is the owner of the building, located at 1680 Michigan Avenue, and is requesting a revocable permit for the installation of address signage and decorative aluminum channels on the facade of the building extending approximately three inches (3") over the sidewalk (into the air rights of the right-of-way); and WHEREAS, the Applicant is proposing to improve the appearance of the façade of the Condominium; and WHEREAS, the Condominium has a 40 foot high, 120 foot long parking pedestal that is a bland expanse of stucco, flush against the property line; and WHEREAS, the Applicant would like to install a building address sign and 44 illuminated channels distributed in a contemporary pattern across the façade of the parking pedestal to make the façade more visually attractive; and WHEREAS, the channels will project approximately three inches (3") over the public right-of-way, starting at approximately 10 feet and extending 37 feet above grade; and WHEREAS, pursuant to Section 82-93(a) of the City Code, the City Commission desires schedule the public hearing to consider the request for a revocable permit; and WHEREAS, the Administration recommends scheduling of the public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission, pursuant to Section 82-93(a), of the City Code, hereby set a public hearing to consider approving a revocable permit request by 1680 Michigan Condominium Association, in order to allow the installation of an address sign and decorative aluminum channels on the facade of 1680 Michigan Avenue, which sign and channel settings shall project approximately three inches (3") over the public right-of- way, and approximately 10 feet to 37 feet above grade. RECOMMENDATION The Administration recommends that the Mayor and City Commission approve the Resolution setting a Public Hearing for this revocable permit. ANALYSIS 1680 Michigan Condominium Association, Inc., (Applicant) owns and manages the Condominiums located at 1680 Michigan Avenue. The Applicant is proposing to improve the appearance of the facade of the Condominium and is requesting a revocable pernit for the installation of a building address sign and forty four (44) illuminated channels, distributed in a contemporary pattern across the facade of the parking pedestal in an attempt to make the façade more visually attractive. The proposed the channels will project approximately three (3) inches over the public right-of-way, starting at approximately 10 feet and extending 37 feet above grade. Pursuant to Section 82-93(a) of the City Code, the City Commission desires to approve at first reading, and schedule the public hearing to consider the request for a revocable permit and, additionally, in accordance with Section 82-93(b) of the City Code, to mail notice of the public hearing to owners of land lying within 375 feet of the existing permit area. The City Code provides the ability to obtain a revocable permit for encroachment into the public right- of-way. The Applicant satisfies the revocable permit criteria stated in Section 82-94 of the City Code ad follows: • The Applicant's need is substantial. Page 606 of 1103 The Applicant respectfully requests that a revocable permit be granted for the proposed address signage and decorative aluminum channels. The revocable permit will allow the Property to maintain its current function, and improve visibility and appearance. • The Applicant holds title to an abutting property. The Applicant owns the Property. • The proposed improvements will comply with applicable codes, ordinances, regulations, neighborhood plans and laws. The proposed improvements will be installed per applicable codes under a separate Building Department permit and does not obstruct the right-of-way. The improvements will have no adverse effect on governmental/utility easements. • That the grant of the revocable permit will enhance the neighborhood and/or community by such amenities as, for example, enhanced landscaping, improved drainage, improved lighting, and improved security. The proposed improvements will promote visibility and appearance of the building. The introduction of the improvements will increase the value of the Property, and in turn that of the neighborhood. Furthermore, it will be desirable to visitors by enhancing the facade. • That granting the revocable permit requested will not confer on the applicant any special privilege that is denied by this article to other owner of land, structures or buildings subject to similar conditions located in the same zoning district. Granting the revocable permit will not confer any special privilege upon the Applicant. Any property owner within the City of Miami Beach can apply for a revocable permit; provided that the application meets the criteria stated in the Code does not interfere with the utilization of public property, and enhances the community. • That granting the revocable permit will not devalue any of the adjacent properties and will not have a detrimental effect on the public welfare. In fact it will improve the historic character of the property and the surrounding area.
