Resolution 6843 RESOLUTION NO. 6843
WHEREAS, by the terms of that certain plat recorded
in Plat Book 14, at page 35, of the Public Records of Dade County,
Florida, there was reserved for perpetual use for wire lines
pipe lines, poles, etc. , the following described property situate,
lying and being in Dade County, Florida, to-wit :
The easterly 5 feet of Lot 17, and
the westerly 5 feet of Lot 18, all
in Block 7 of BISCAYNE POINNT, ac-
, cording to the Plat thereof, re-
corded in Plat Book. 14, at page 35,
of the Public Records of Dade County,
Florida;
and
WHEREAS, Charles C. and Aileen B. Meyer, as owners of
Lot 17, and that part of Lot 18 of said Block 7, described as
follows :
Begin at the easterly corner of Lot 17;
thence southeasterly twenty-five (25)
feet; thence southwesterly one hundred
fifty (150) feet, more or less, to a
point twenty-three and two hundred seven-
teen thousandths (23.217) feet southeasterly
of the southerly corner of Lot 17; thence
northeasterli to the point of beginning,
have heretofore granted to the City of Miami Beach, Florida, an
easement over and across the westerly 5 feet of said Lot 17 of Block
7 for perpetual use for said above-mentioned purposes, as recorded
in Deed Book 3124, at page 116, of the Public Records of Dade County,
Florida, and

WHEREAS, the said owners of the above-described property
have requested that said property be released from said reservation
and said grant of easement, and
WHEREAS, the said reservation and the said grant of ease-
ment have never been used by the public generally or by the City of
Miami Beach for any public Purpose; and that the City of Miami Beach
has no contemplation of such public use nor any purpose in retaining
such rights in said property; and
WHEREAS, the City Attorney has prepared and submitted
an instrument for execution by said City whereby all rights con-
ferred upon or granted to the said City by virtue of the above-
described reservation and grant of easement are relinquished and
surrendered by the said City,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute said
instrument in the name of and on behalf of said City.
