Resolution 6992 RESOLUTION NO. 6992
WHEREAS, the Honorable George E. Holt, Judge of the Circuit
Court of the Eleventh Judicial Circuit of Florida, in and for
Dade County, has heretofore, to-wit: on the 19th day of August,
1949, entered his order in that certain cause in said Court
pending entitled City of Miami Beach, Plaintiff, versus Olive
Wofford, et al, bearing Number 66510-A, whereby the City of
Miami Beach and Marcie LibermanD. Lee Powell, Harold Turk,
William Burbridge, Maurice D. Klein, Burnett Roth and Melvin
J. Richard, as Members of the City Council of the City of Miami
Beach, are required before 12:00 o'clock Noon, Tuesday, August
23 , 1949, to officially and effectively revoke, rescind and
disclaim Resolution No. 6653, dated September 17th, 1948, and
reinstate City Permits ,x28194 and #28221 for the construction
of a bulkhead and of a swimming pool, respectively, or else to
be each personally present before said Court in Chambers at
Miami, Florida, at 12:00 o'clock Noon on August 23, 1949, and
then and there show cause why the said City and said Members of
said City Council as such members should not be adjudged in con-
tempt for disobedience of the Final Decree of Injunction hereto-
fore entered in said cause, pursuant to the decision and mandate
of the Supreme Court of Florida on file in said cause, and show
cause why the motion of the Miami Beach Improvement Company,
Gibbons Associates and Surf Properties, Inc. , for judgment and
other relief, heretofore filed in said cause, should not be
granted,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that Resolution No. 6653, passed
and adopted on the 17th day of September, 1948, by said City
Council, be and the same is hereby revoked, rescinded and dis-
claimed.
BE IT FURTHER RESOLVED. that City Permits , 28194 and ;,`28221
for the construction of a bulkhead and of a swimming pool, res-
pectively, be and they are hereby reinstated.
