Resolution 7067 RESOLUTION NO. 7067

WHEREAS, the City Council of the City of Miami Beach,
Florida, is considering amending and changing certain of the regula-
tions and restrictions established and contained in Ordinance No. 289,
commonly known as the "Zoning Ordinance of the City of Miami Beach,
Florida" , as hereinafter set forth, to-wit:
To amend Section 16 of said ordinance so as to eliminate
the requirement for side yards in Area District No. 42 and in Area
District No. 45, where accessory buildings are constructed in said
Area Districts pursuant to the provisions of Sub-paragraph "h" of
Sub-section 3 of Section 17 of said ordinance, and
To amend Section 1 of said Ordinance so as to define the term
"night club" to read as follows:
"Club? Night: The term "Night Club" shall
pertain to and include restaurants, dining
rooms, or other establishments where intoxicating
liquor is sold , given away or consumed on the
premises, and where floor shows or other forms
of entertainment are provided for guests at any
time between the hours of 1:00 o'clock A. M.
and 7:00 o 'clock A.M."
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that a public hearing be and is hereby
called to be held on the 14th day of December, A. D. 1949, at 10:00
o 'clock A. M. , in the Council Chambers, in the City Hall, Miami Beach,
Florida, for the consideration of said amendments.
BE IT FURTHER RESOLVED, that the City Clerk be and he is
hereby directed to give at least fifteen days ' notice of the time, place
andobject of said hearing by publishing notice thereof in the Florida
Sun, a newspaper of general circulation in said City of Miami Beach,
Florida, in conformity with Section 21 of Ordinance No. 289 of said City.
PASSED and ADOPTED this 2.3rd day of November, A. D. 1949.
