RESOLUTION NO. 7113
WHEAS, the City Council of the City of Miami Beach,
Florida, deems it necessary for the welfare of said City
and the inhabitants thereof to acquire for street and other
• municipal purposes for the use of said City and its inhabi-
tants the following lands situate, lying and being in Miami
Beach, Dade County, Florida, bounded as follows, to-wit:
Beginning at a point which is the intersection
of the easterly shore line of Indian Creek with
the southerly line produced westerly, of Lot
Ten (10) of Block Ten (10) of the Ocean Front
Property of the Miami Beach Improvement Company,
according to the Amended Plat thereof, recorded
in Plat Book 5, pages 7 and 8, of the Public
Records of Dade County, Florida; thence easterly
along the said southerly line of said Lot Ten (10)
produced as aforesaid, a distance of Twenty-five
(25) feet, more or less? to a point on the westerly
line of Indian Creek Drive; thence northerly along
the westerly line of Indian Creek Drive a distance
of Twenty (20) feet; thence westerly along a line
parallel to and twenty (20) feet northerly of said
southerly line of said Lot Ten (10) produced as
aforesaid, a distance of Twenty-five (25) feet,
more or less, to a point on the easterly shore line
of Indian Creek; thence southerly meandering along
the easterly shore line of Indian Creek to the point
of beginning, together with all statutory and common
law riparian rights;
NUJ, THEREFORE, BE IT RESOLVED AND DECLARED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, THAT IT IS necessary
that the fee simple title to all of the above-described property
be acquired for use and maintenance for street and other munici-
pal purposes for the benefit of said City and its inhabitants,
and
BE IT FURTHER RESOLVED that the City Attorney be and he is here-
by authorized and directed to institute the necessary legal proceed-
ings in the name of said City in the exercise of its right of eminent
domain for the condemnation of said property for said purposes.
