Resolution 7184 RESOLUTION NO. 7184 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AMENDMENTS TO THE PERSONNEL RULES OF SAID CITY. WHEREAS, the Director of Personnel of the City of Miami Beach, Florida, has prepared amendments to the Personnel Rules of said City by the terms of which said amendments Sub-paragraph 3 of Paragraph (a) of Section 3 of Rule XII of the Personnel Rules will read as follows : "3. Any portion of the Annual Leave of a Regular Employee, not otherwise used shall be accumulated, and after the earned balance of Annual Leave to the credit of such Regular Employee at the end of the calendar year shall be such that longer than normal vacations can be granted without the resulting time charged for such vacation reducing the earned balance below sixty (60) days, such Regular Employee may be granted a vacation not to exceed twenty (20) work days. Any earned balance of Annual Leave, including credits provided for in Paragraph (a) 4 of this Section, of a Regular Employee who dies in the service of the City, or who retires under the terms of any City Pension Plan, shall be paid to the beneficiary or employee respectively at the rate of compensation received by such Regular employee at the time of his death in service or retirement. Any earned balance of Annual Leave, deducting therefrom any credit granted under the provisions of Paragraph (a) 4 of this section, of, a Regular Employee who resigns in good standing shall be paicT to such Regular Employee at the rate of compensation received by such Regular Employee at the time of his resignation in good standing , provided that such payment shall not be made until such time as the resigned Regular Employee shall forfeit his right to re-employment either by time limitation or by written forfeiture of all Civil Service rights. Such payment for balance of Annual Leave payable to a retired Regular Employee, a bene- ficiary of a deceased Regular Employee or to a resigned Regular Employee shall in no case exceed an amount equal to one year' s compensation at the rate of pay received by such Regular Employee at the time of his retirement, death or resignation." and by the terms of which said amendments Paragraph (a) of Section 3 of Rule XII of the Personnel Rules is amended by adding thereto at the end thereof, the following: "3.1 Effective January 1, 1949, Regular Employees may add to each yearly vacation to which they are otherwise entitled, without charge against their Annual Leave Credit, as follows : If having more than 10 but less than 20 years of service 1 week If having more than 20 years of service 2 weeks Service for the above purpose shall be taken as creditable service under a City Pension Plan, except that: Members of the Police and Fire Pension System shall have added to their creditable service under that System any time other than Police or Fire service which was credited to them under Ordinance No. 498, and which was forfeited by reason of their joining the Police and Fire Pension System; and except that: -1- OFFICE 1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA Members of either retirement system, who were first employed on or after December 7, 191+1, shall have added to their creditable pension service, if not already included, any time served continuously and immediately preceding their Regular appointments, whether Provisional or Probationary, where con- tinuously shall be construed to mean following any absence without pay greater than thirty (30) days. 3 .2 Where the City shall by proper legal means assume as a City operation, any existing private or quasi public business or activity, and by the terms shall cover in its employees as City Employees, such employees shall be granted initial leave credits on the same basis and under the same terms and conditions as though they had previously been em- ployed by the City on Provisional appointments." and WHEREAS, the Personnel Board of said City has heretofore approved said amendments, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that said amendments to said Personnel Rules be and the same are hereby approved.
