Resolution 7313 RESOLUTION NO. 7313
WHEREAS, a certain building has heretofore been erected
under a permit issued by the City of Miami Beach , upon
Lots 15 and 16 of Block 27 of
OCEAN BEACH ADDITION NO. 2, according
to the Plat thereof, recorded in Plat
Book 2, at pa .e 56, of the Public
Records of Dade County, Florida; and
WHEREAS a recent survey prepared by Zurwelle-.Ihittaker, Inc. ,
Structural hngineers and Surveyors, copy of which sketch of survey
and engineer' s certificate being hereto attached, reveals that the
building located on said property encroaches upon the sidewalk along
Fourteenth Street, lying north of said property, in varying degrees
up to 0.03 feet, and that the building encroaches upon the sidewalk
on Washington Avenue to the west of said property in varying degrees
up to 0.22 feet, all of which more fully appears from the said sketch
of survey hereto attached; and
WHI-1AS, it is the opinion of the City Council that the said
encroachments were unintentional;
NOW, THEREFORE, BE IT RESOLVTD by the City Council of the City
of Miami Beach, Florida, that no action of any kind whatsoever shall
be taken by the City of Miami Beach to require the owners of said
property, their heirs, successors or assigns, or persons, firms or
corporations claiming by, through or under them, to move or remove
the structure or structures located on said premises by reason of
said encroachments; and such owners are granted permission to main-
tain such encroachments as they now exist, until such buildings or
structures are destroyed or removed.
