Resolution 7506 RESOLUTION NO. 7506
WHEREAS, the City has heretofore entered into a written
agreement with BENJAMIN KOVNAT and MOLLIE KOVNAT, his wife, for
the purchase for street construction purposes of that certain
parcel of land situate, lying and being in Miami Beach, Dade
County, Florida, described as follows, to-wit :
Lot Twelve ( 12) of Block rive (5) of
the TOWNSITE OF i-lARDING, according
to the Plat thereof, recorded in Plat
Look 34, at page 4, of the irublic
Records of Dade County, Florida;
AND WHEREAS, it appears that certain legal proceedings
by the Sellers have become necessary in order to establish their
good and marketable title in and to said property and that the
Sellers have undertaken so to do and that time required for the
completion of said proceedings is delaying the application of
said property together with adjoining properties heretofore ac-
quired by the City to the public use contemplated; and
WHETtEAS, it is the desire of the City to enter upon said
property and to construct said street pending the consummation
of the transaction between the parties above described; and
WHEREAS, Benjamin Kovnat and Mollie Kovnat, his wife,
have indicated their willingness to enter into a supplementary
agreement to accomplish the objects hereabove set forth; and
WHEREAS, the City Attorney has prepared an agreement
the terms and provisions of which the City Council has been
fully advised;
NOW, THN(EFORE, BE IT RESOLVED by the City Council of
the City of Miami beach, rlorida, that the Mayor and the City
Clerk be and they are hereby authorized to execute the said
agreement in the name of andon behalf of said City.
