Resolution 7507 RESOLUTIOi NO. 7 507
WHEREAS, the City of Miami Beach, Florida, is desirous
of obtaining for the purpose of widening Indian Creek Drive,
a public street in said City, a strip off the east side of the
following described parcel of land situate in Miami Beach, Florida,
to-wit:
Lot Thirty-five (35) of Block Three
(3) of SECOND OCEAN FRONT SUBDIVISION,
according to the Amended Plat thereof, '
recorded in Flat Book 28, at page 28,
of the Public Records of Dade County,
Llorida;
and
a
s1IHEHEAS, Prudential Realty, Inc . a Rhode Island Corpora-
tion, is the owner of said land , and 6790 Indian Creek Drive Corp. ,
a Florida. Corporation, is the Lessee of said land under a long
term lease, and R. K. Cooper, Inc. , a Florida Corporation, is the
owner and holder of a mortgage encumbering said land; and
:dHEREAS, in contemplation of dedicating said strip of land
to said City, the owner has caused to be filled to an elevation of
2. 5 feet above mean high water, a tract of submerged land in Indian
Creek lying westerly of and adjacent to the lands hereinbefore des-
cribed, said area so filled being equal in depth and area to the
depth and area of the strip of land to be dedicated as aforesaid;
and
' WHEREAS, the construction of said fill has made necessary
the construction of a seawall or bulkhead for the purpose of retain-
ing and protecting the fill, which bulkhead and seawall has hereto-
fore been constructed by the owner the total cost of said bulkhead
and fill being the sum of - 5, 536.48 which amount is now due and un-
paid to M. F. Comer Bridge & Foundation Co. , for the construction of
said bulkhead and fill; and
WHEREAS, in contemplation of said dedication the City has
heretofore procured from the Trustees of the Internal Improvement
Fund of the State of Florida, a deed conveying to said owner the
tract of submerged land filled as aforesaid; ,
NOW, THEREFORE, BE IT R-ESOLVED by the City Council of the
City of Miami Beach, Florida, that the City Manager and the dis-
bursing officers of the City be and they are hereby authorized and
directed to deliver to said owner the deed from the Trustees of
the Internal Improvement Fund of the State of Florida and to pay
to M. F. Comer Bridge a Foundation Co. , the sum of $2,610.43 on
account of the amount due as aforesaid, upon the payment by the
owner of the sum of : 2,926.00 to M. F. Comer Bridge & Foundation
Co. , on account of the amount due as aforesaid and the delivery
by the owner and the said Lessee to the City of a Deed of Dedica-
tion covering the easterly Forty (40) feet of the land heretofore
described and a release thereof from the lien of the mortgage
hereinbefore referred to.
