Resolution 7515 RESOLUTION NO. 7515 WHEREAS, ARTHUR L. :MALT.;_RS and LOUISE B. .ALTERS, his wife, have offered to sell to the City of Miami Beach, Florida, for the sun of : 600.00 in cash and other considerations more speci- fically set forth in that certain agreement hereinafter referred to, those certain parcels of land situate, lying and being in Miami Beach, Dade County, Florida, described as follows , to-wit: Parcel "A". The northerly seven and one-half (7 ) feet of Lot Twenty-nine (29) , Block Three (3) FLAIUNGO TERRACE SUBDIVISION, according to the Plat thereof, recorded in Plat Book 10 Page 3, of the Public Records of Dade County , a Florida. Parcel "B" That portion of the said Lot Twenty-nine (29) , bounded as follows: Commence at the northeasterly corner of said. Lot Twenty-nine (29) ; thence run in a westerly direction along the northerly line of said Lot Twenty-nine (29) a distance of sixty-five (65) feet to a point; thence de- flecting to the left ninety (900) degrees run in a southerly direction seven and one- , half (71) feet to the point of beginning of the tract of land herein described. From said point of beginning run in an easterly direction along a line parallel to the northerly line of said Lot Twenty-nine (29) for a distance of sixty-five (65) feet, more or less, to a point on the easterly line of said Lot Twenty-nine (29) ; thence southerly along the easterly line of said Lot twenty-nine (29) to a point, which is fifteen (15) feet southerly of the northerly line of Lot Twenty-nine (29) , measured at right angles to said northerly line of Lot Twenty- nine (29) : thence westerly along a line for a distance of sixty-five (65) feet, more or less, to the point of beginning; as said lot, block and subdivision are shown on Plat recorded in Plat Book 10, Page 3, of the Public Records of Dade County, Florida. AND WHEREAS, the City Council of the City of Miami Beach Florida, deems it to be to the best interest of said City to acquire said lands for the said considerations, for the purpose of widening Forty-first Street (41st Street) , -; public highway in said City, and for the further purpose of constructing and maintaining the approach to the westerly side of the Forty- first Street (41st) Bridge, AND WHEREAS, an agreement has been prepared by the City Attorney by the terms of which the said Arthur L. Walters and Louise B. Walters, his wife, agree to sell and convey and the City agrees to purchase said lands, the City Council being fa- miliar with the terms of said agreement, -1 - OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA • NOW, THEREFORE; BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the Mayor and the City Clerk be and they are hereby authorized to execute the said agreement, and any and all instruments which may be necessary to accomplish the said transaction in the name of and on behalf of said City. BE IT FURTHER RESOLVED that the City Manager be and he is hereb,.r authorized to close the transaction contemplated by said agreement according to the terms thereof, as and when the title shall have been approved by the City :attorney; and the disbursing officers of the City be and they are hereby authorized to pay out `of the funds of the City, available for such purpose, the amount necessary to comply with the terms of said agreement.
