Resolution 7657 RESOLUTION NO. 7657
WLIEREAS, a certain building has heretofore been erected
upon that certain parcel of land situate in the City of Miami
Beach, Florida, described as follows:
Lot Three (3) , Block Thirty-one ( 31) , LAKE
VIEW SUBDIVISION, according to the Plat
thereog recorded in Plat Book 14, page 42,
of the Public Records of Dade County, Florida;
AND WHEREAS, Ordinance No. 289, commonly known as the
"Zoning Ordinance of the City of Miami Leach, " requires that
there be a side yard of not less than five (5) feet on either
side of a building erected upon the aforesaid property;
AND WHEREAS, a survey was made on the 21st day of May,
1951, by Zurwelle-Whittaker, Inc. , a copy of which survey is
attached hereto, which survey reveals that said building en-
croaches a distance of sixty-five one-hundredths of one ( .65)
foot into the side yard required by said Zoning Ordinance;
AND W}:EREAS, it is the opinion of the City Council that
said encroachment was unintentional, is of a trivial nature,
and does not materially affect or interfere with the contem-
plated use of the above-described. property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Miami Beach, Florida, that in so far as the said
City Council has the power to bind the City of Miami Beach,
Florida, in the premises, no action of any kind whatsoever
shall be taken by said. City to require the owners of the
above-described property,‘ their heirs, successors and assigns,
to move, or remove, that portion of the structure encroaching
upon said setback as aforesaid.
