Resolution 7660 RESOLUTION NC. 7660
WHEREAS, by the terms of that certain slat recorded in
Plat book Forty-four. 014 ) , at Page Sixty-seven (t7 ) of the Public
Records of Dade County, Florida., there was reserved for use for
public utilities, the following described land situate, lying and
being in Dade County, Florida, - to-wit:
The northerly two and one-half ( 2 1/2) feet of
Lot Twenty-five (25) , Block Ten (10) , Biscayne
Beach Subdivision, according to the Plat thereof
recorded in Plat Book Forty-four (t4) , at Page
Sixty-seven ( 67) of the Public Records of Dade
County, Florida,
and
WHEREAS, the owners of said lands have requested the City
of Miami Beach to relinquish and surrender all rights conferred upon
or granted to said City by virtue of said Plat as to the lands herein
above described, and
WHEREAS, said owners have offered, in consideration of such
relinquishmdnt and surrender, to grant to the City of Miami Beach an
easement over and across the fol].owing described lands , situate, lying
and being in Dade County, Florida, to-wit:
The southerly two and one-half ( 2 1/2) feet
of Lot Twenty-five (25) , Block Ten (10) ,
Biscayne Beach Subdivision, according to the
Plat thereof recorded in Plat Book Forty-four
(14J1..) , at Page Sixty-seven (67 ) of the Public
Records of Dade County, Florida,
and
WHEREAS, the City Attorney has prepared and submitted an
instrument for execution by said City accomplishing the exchange
of easements as above set forth,
NOW, THEir FORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said instru-
ment in the name of and on behalf of said City.
BE IT ii URTHER RESOLVwD that the City Attorney be and he Is
hereby authorized and directed to deliver said executed instrument if,
as and when there has been delivered to him a good and sufficient grant
unto the City of Miami Beach, Florida, of a perpetual easement over,
under and across the southerly two and one-half ( 2 1/2) feet of Lot
Twenty-five (25) , Block Ten (10) , above referred to.
