Resolution 7664 RESOLUTION NO. 7664 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AMENDMENTS TO THE PER- SONNEL .RULES OF SAID CITY. :1HEREAS, the Director of Personnel of the City of Miami Beach, Florida,• has prepared amendments to the Personnel ' les of said City by the du terms of which that portion of Sub-section (d) of Section 2 of Rule XII of the Personnel Rules , reading as follows: "(d) APPOINTMENT TO UNCLASSIFI ,D STERVICE: Any regular employee in the Classified Service of the City who may be selected for appointment to an office in the Unclassified Service shall be granted a Leave of Absence for the period of his service in Such office, provided that such Leave of Absence shall in any case terminate with his third consecutive appointment to such office. The position from which such employee shall be granted Leave of Absence shall not be filled during the period of the Leave except by Provisional Appointment, Assignment or Substitute Appointment, and no person so filling such posi- tion shall acquire any permanent rights therein. Upon expiration of such Leave of Absence, either by voluntary cancellation by such employee or by time limitation, the position shall be declared vacant, and regular competitive procedures shall govern filling it on .a permanent basis." is amended to read as follows: "(d) APPOINTMENT TO UNCLASSIFIED SERVICE: When any Regular Employee in the Classified Service shall be appointed to an office or position in the Unclassified Service, his position in the -Classified Service shall be considered vacated, and shall be filled by the regular competitive procedures which apply to filling such positions on a permanent basis. The Regular employee so appointed to the Un- classified office or position shall retain his Classified Service title and status. If separa- ted from his Unclassified office or position, and there shall be a vacancy in his former Classified position, he shall be given the opportunity of returning to that position. If there shall be no such vacancy, he shall be given the opportunity of accepting a Classified position at the same kind of work and at a comparable level, in his former department if practicable, with compensation at the maximum rate then prevailing for his Classification; such determinations to be made by the Personnel Board . If such employee shall not accept the position approved by the Personnel Board within six (6) months after his separation from his Unclassified position, he shall forfeit all rights under this :pub-section.
