BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, AS FOLLOWS: SECTION 1. In accordance with provisions of the Charter of the City of Miami Beach, Florida, and the general laws of the State of Florida, a Special Election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7:00 a.m. to 7:00 p.m. on Tuesday, November 6, 2018, for the purpose of submitting to the electorate the question as set forth hereinafter. SECTION 2. That the appropriate and proper Miami-Dade County election officials shall conduct the Special Election hereby called, with acceptance of the certification of the results of the Special Election to be performed by the City Commission. The official returns for each precinct shall be furnished to the City Clerk of the City of Miami Beach as soon as the ballots from all precincts have been tabulated. SECTION 3. That the voting precincts in the City of this Special Election shall be as established by the proper and appropriate Miami-Dade County election officials. All electors shall vote at the polling places and the voting precincts as determined by the Miami-Dade County election officials) SECTION 4. Pursuant to City Code Section 38-3(b), "[t]he City Clerk shall further publish, in a newspaper meeting the requirements set forth in Florida Statutes § 50.031 and on the City's website, the polling places for the election twice, once in the third week and once in the first week prior to the week in which the election is to be held." Not fewer than thirty days' notice of the adoption of this Resolution and of its provisions calling this Special Election shall be given by publication in the Miami Herald, a newspaper of general circulation in Miami Beach, Miami-Dade County, Florida. Such publication shall be made in accordance with the provisions of Section 100.342, Florida Statutes, and Section 38-3 of the Code of the City of Miami Beach. SECTION 5. SECTION 8. Registration of persons desiring to vote in the Special Election shall be in accordance with the general law of the State of Florida governing voter registration. Qualified persons may obtain registration forms to vote at the Office of the City Clerk, City Hall, 1700 Convention Center Drive, First Floor, Miami Beach, Florida 33139, during normal business hours, and at such other voter registration centers and during such times as may be provided by the Supervisor of Elections of Miami-Dade County. The Miami-Dade County Supervisor of Elections will register voters for this Special Election until 5:00 p.m. on October 9, 2018. All persons eligible to vote in this Special Election must be registered before the time and date set forth herein or have registered previously, as provided by law. Each person desiring to become a registered voter shall be responsible for properly filling out the registration form and returning it to the Miami-Dade County Elections Department. BACKGROUND The Administration has developed a proposed General Obligation (G.O.)Bond program as part of the City's Capital Improvement Program for consideration by the voters of Miami Beach on November 6, 2018. A general obligation bond is a form of debt financing payable solely from property taxes, backed by a pledge of the City's "full faith and credit" or taxing power, and used to finance capital projects. Pursuant to Article VII of the Florida Constitution, G.O. bonds may only be issued if they are approved by a majority of the voters voting in a City-wide referendum. The proposed G.O. Bond package includes a list of the capital projects that the City would implement with bond proceeds and proposed ballot question language. The Capital Improvement Program is a six-year plan of public improvements and capital expenditures that is intended to serve as the official statement of public policy regarding long-range physical development in the City of Miami Beach. A capital improvement is defined as a capital expenditure of $25,000 or more resulting in the acquisition, improvement,or addition to fixed assets in the form of land, buildings,or improvements and heavy equipment with an expected live of at least five years. The Administration is recommending a G.O. Bond at this time to address critical infrastructure needs in the community. Current funding for capital projects in the City's operating budget is very limited compared to the number and costs of capital requests. Costs of borrowing are currently low and it is still possible to take advantage of historically low interest rates. According to the City's Financial Advisor, interest rates are expected to rise over time, potentially increasing the costs of borrowing substantially. In terms of debt capacity, the City is authorized to issue G.O. debt up to 15% of assessed property value, which is $5.2 billion (as of 9/30/17). The City is currently at 0.86%, which is less than 1% compared to the debt limit of 15%. If the proposed G.O. Bond program is approved, the City's debt would be at 8.6% compared to the debt limit of 15%. In addition,the City's current credit rating is strong at AA+. Over the last year, both Moody's and Standard&Poor's credit rating agencies have put local governments on notice that they could face potential credit downgrades if climate change effects are not addressed. According to the City's Financial Advisor, the City could pay additional significant interest costs if downgraded to AA-. The proposed G.O. Bond program includes capital projects that help address negative effects of climate change. General Obligation Bond Program Development Page 2 ANALYSIS At the Finance & Citywide Projects Committee meeting on July 21, 2017, the Committee provided direction to move forward with a proposed G.O. Bond program and set a goal of the voter referendum date for the general election on November 6, 2018. On January 17, 2018,the City Commission directed staff to formalize the process to develop the proposed 2018 G.O. Bond program including creating a timeline, dedicating necessary staff resources, and creating standing items on the agendas for upcoming City Commission and Finance&Citywide Projects Committee meetings through the planned voter referendum date of November 6, 2018. During February and March, an initial project list totaling $1.1 billion was compiled from various sources. Sources included input from the City Commission, over a dozen City master plans(ex. North Beach Master Plan), over 40 City boards and committees(ex. Parks & Recreation Advisory Board), and staff recommendations. On April 5, 2018, the City Commission held a G.O. Bond workshop to review and prioritize the unfiltered list of projects. By the end of the meeting, $1.1 million list of projects was reduced to about $700 million. At that time, the City Commission directed staff to solicit community input to help rank and prioritize the project list. During May and June,four community meetings were held in North, Mid,and South Beach. Flyers encouraging public participation in the meetings were sent to all registered voters in Miami Beach. At the community meetings, approximately 150 participants had the opportunity to learn about the proposed 2018 G.O. Bond program, the proposed projects, and the overall process. Most importantly, participants were able to provide valuable input regarding the proposed projects by reviewing project boards with descriptions of the projects, asking questions of key staff, providing verbal and written comments,and rating the proposed projects on a 5 point scale. An on-line project prioritization survey was also created to reach residents that were unable to attend one of the community meetings. The survey was available on-line through mid-July and included input from 540 residents, including the surveys from the four community meetings. Numerous presentations were also given throughout the community including Miami Beach United,Tuesday Morning Breakfast Club, Thursday Morning Breakfast Club, Mid-Beach Neighborhood Association, West Avenue Neighborhood Association, South of Fifth Neighborhood Association, and Collins Park Neighborhood Association. Information was also distributed to numerous residents at pop-up events such as Ciclovia, Friday Night Live, and the Food Truck & Music Fest. On May 16, 2018, the City Commission approved a resolution expressing their intention to create a G.O. Bond Oversight Committee if the G.O. Bond is approved by the City's electorate in November 2018. In May 2018, Mayor Dan Gelber created a Mayor's G.O. Bond Advisory Panel consisting of eleven Miami Beach residents to serve through November 30, 2018. The charge of the Advisory Panel, chaired by Karen Rivo, is to evaluate projects and make advisory, non- binding recommendations regarding the prioritization of proposed G.O. Bond projects. The Mayor's G.O. Bond Advisory Panel met six times during June and July for over 25 hours. The Advisory Panel reviewed the work to date including results of the City Commission's April 5th G.O. Bond workshop. They analyzed and prioritized the proposed project list,which included presentations from City department directors and the City Manager, reviewing results of public input from the project prioritization surveys, and developed prioritization criteria for the projects. Bond On July 17,2018,the Mayor's G.O. Bond Advisory Panel shared its recommendations to the City Commission. The Advisory Panel began with a proposed project list totaling about$700 million and 90 projects and prioritized the project list at three levels: • $444 million; 37 projects • $398 million; 35 projects • $353 million; 32 projects The meetings of the Advisory Panel are open to the public and information such as meeting schedules, meeting minutes, audio, and video of the meetings are available at www.GOMB2018.cam. The City Commission held a workshop at a special meeting on July 20,2018,to finalize the proposed project list, set the amount of the overall bond program,and determine the number and amounts for each ballot measure. A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, OPPOSING THE USE OF THE MELREESE GOLF COURSE, THE ONLY PUBLIC, MUNICIPAL-OWNED, AND RESILIENT GOLF COURSE GREEN SPACE IN THE CITY OF MIAMI, FOR THE CONSTRUCTION OF A SOCCER STADIUM AND AN OFFICE, RETAIL,AND HOTEL COMPLEX. WHEREAS, a group of local and foreign investors have approached the City of Miami and Miami-Dade County with a proposal to build a 25,000 seat major league soccer stadium, along with an office, retail, and hotel complex of at least 1 million square feet, on the site of the Melreese Country Club golf course ("Golf Course"), the City of Miami's only public course; and WHEREAS, the Golf Course is located on 135 acres and includes five lakes, nine waste bunkers, 97 sand bunkers, and a cypress wetland; and WHEREAS, the Golf Course is a vast and environmentally resilient green space that has a half million dollar drainage system that allows for golf play when most other courses are unplayable and may, in the future, serve as a crucial permeable area for future storm water absorption; and WHEREAS, sea level rise is a matter of serious concern for all global coastal areas, and, particularly, for South Florida, which is already experiencing sunny day flooding and is built on porous limestone; and WHEREAS, converting a resilient green space, with a state-of-the-art drainage system, into a massive concrete development is counter to the efforts to address climate change in our community; and WHEREAS, a proposed Tenn Sheet for the soccer stadium and commercial complex reveals that a new park, replacing only 58 acres of greenspace, is planned for the site; and WHEREAS, nowhere in the Term Sheet are traffic congestion or transportation infrastructure impacts addressed for the proposed 25,000 seat stadium, the minimum 1 million square foot development of office, retail, and entertainment space, or the 750 room hotel and conference center; and WHEREAS, the influx of traffic that will result from this development, planned adjacent to Miami International Airport and two major roadways leading to Miami Beach (the Don Shula/836 Expressway and SR 112), will create new and significant traffic impacts along these gateway corridors to Miami Beach; and WHEREAS, instead of paving over expansive green spaces that are currently resilient, and developing a project that will cause major traffic congestion and significantly impact transportation infrastructure, alternative locations for the proposed soccer stadium and commercial complex should be seriously considered or, at a minimum, a comprehensive traffic mitigation plan and roadway infrastructure improvements must be required. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby oppose the use of the Melreese Golf Course, the only public, municipal- owed, and resilient golf course green space in the City of Miami, for the construction of a soccer stadium and an office, retail, and hotel complex.
