Resolution 7756 RESOLUTION NO. 7756
WHEREAS, A. E. MU YER and PAULINE A. MUNYER his wife,
are the owners of that certain parcel of land situate in Miami
Beach, Dade County, Florida, described as follows, to-wit:
Lot 1 in Block 3 of SECOD OCEAN FRONT
SUBDIVISION, according to the Amended
Plat thereof, recorded in Plat Book 28,
at page 28, of the Public Records of Dade
County, Florida,
AND '.WHEREAS, said owners have offered to sell to the City
of Miami Beach a small portion off the southeast corner of said
Lot 1 for street widening purnoses in consideration whereof, the
City to pay the sum of Ten (A0.00) Dollars, and to agree, if possi-
ble for it to do so, to obtain for the owners title to and to
bulkhead and fill a strip of submerged land in Indian Creek lying
westerly of and immediately adjacent to said Lot 1, said tract of
submerged land to be twenty-five (25) feet wide at the southerly
end thereof and thirty (30) feet wide at the northerly end thereof,
the City to pay the cost of acquiring the title to said submerged
land and to pay the cost of the fill and the Placing thereof and the
owners to pay for the cost of the bulkhead, and
':IHLHEAS, the owners have also offered to lease to the City,
for a term tof three (3) years beginning February 1, 1952, at a
rental of u100.00 per month, the remainder of said Lot 1, and
:01HEREAS, the City Council deems it to be to the best interest
of the City to accept said offer and the City Attorney having pre-
pared an agreement between the parties covering the proposed trans-
actions with the terms of which said agreement the City Council is
familiar,

NOW, THEREFORE, BE IT 1 ESOLVE;D by the City Council of the
City of Miami Beach, Florida, that the iayor and the City Clerk be
and they are hereby authorized to execute said agreement in the
name of and on behalf of said City and the City Manager be and he
is hereby authorized and directed to consummate the transaction con-
templated by said agreement and the disbursing officers of the City
be and they are hereby authorized and directed to disburse the sums,
required under the terms of said agreement to be expended by said City,
out of funds of said City available for such purpose.
