RESOLUTION NO. 7853
WHEREAS, by the terms of that certain instrument
recorded in Deed Book one thousand nine hundred thirteen (1913 ) ,
at Page Eleven ( 11) of the Public Records of Dade County, Florida,
there was given and granted unto the City of Miami Beach, Florida,
its successors and assigns and its grantees operating public
utilities , the perpetual right and easement to lay and maintain
storm sewers, underground in the following described land, situate,
lying and being in Dade County, Florida, to-wit:
Beginning at a point which is the intersection
of the southwesterly line of Bay Drive and the
dividing line between Lot Two (2 ) and Lot Three
(3) , Block Thirty-nine (39 ) , Miami View Section
of the Isle of Normandy, Part 1, aser Plat
recorded in Plat Book Thirty-four (34), Page
Eighty (80) of the Public Records of Dade County,
Florida; thence southwesterly along said dividing
lino between Lot Two (2) and Lot Three (3) , a
distance of One Hundred seventy (170) feet , more
or less, to a point on the southwesterly line of
said Lot Three (3 ) ; thence southeasterly along
said southwesterly line of Lot Three (3) , a distance
of five (5) feet, more or less , to a point; thence
northeasterly along a line parallel with and five
(5) feet distant from said dividing line between
Lot Two (2 ) and Lot Three (3) , a distance of one
hundred seventy ( 170) feet, more or less , to a point
on the said southwesterly line of Bay Drive; thence
northwesterly along said southwesterly line of Bay
Drive a distance of five (5) feet, more or less,
to the point of beginning
and
WHEREAS, the owners of said lands have requested the City
of Miami Beach to relinquish and surrender all rights conferred upon
or granted to said City by virtue of said instrument as to the lands
herein above described, and
WHEREAS, said owners have offered, in consideration of such
relinquishment and surrender, to grant to the City of Miami Beach an
easement over and across the following described lands , situate ,lying
and being in Dade County, Florida, to-wit:
The southeasterly five (5) feet of Lot Three (3 ) , Block
Thirty-nine (39 ) , Miami View Section of the Isle of
Normandy, Part 1, according to the Plat thereof
recorded in Plat Book Thirty-four (34) , at Page Eighty
(80) of the Public Records of Dade County, Florida
and
WHEREAS, the City Attorney has prepared and submitted an
instrument for execution by said City accomplishing the exchange of
easements as above set forth,
NOW, THEREFORE, BE IT R ESOLVED by the City Council of the
City of Miami Beach, Florida, that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said instru-
ment in the name of and on behalf of said City.

BE IT FURTHER RESOLVED that the City Attorney
be and he is hereby authorized and directed to deliver said
executed instrument if, as and when there has been delivered
to him a good and sufficient grant unto the City of Miami
Beach, Florida, of a perpetual easement to lay and maintain
storm sewers underground in the following described property,
to-wit:
The southeasterly five (5) feet of Lot Three
(3 ) , Block Thirty-nine (39) , Miami View Section
of the Isle of Normandy, Part 1, according to
the Plat thereof recorded in Plat nook Thirty-
four 3L_) , at Page Eighty (80) of the Public
Records of Dade County, Florida,
PASSED AND ADOPTED THIS 21st DAY OF November,
A.D. 1951.
