Resolution 7858 RESOLUTION NO. 7858
`:JHEREAS, the Owner and Lessee thereof have offered to sell
to the City of i'iiami Beach for the surd of U50,000.00 in cash that
certain parcel of land situate, lying and. being in Miami Beach,
Dade County, Florida, describeas follows :-
The north half of that certain parcel of land bounded as follows:-
Begin
ollows:-Begin at the southeasterly corner of Lot One (1) ,
Block One (1) of FISHER'S FIRST SUBDIVISION of Alton
Beach, as recorded in Plat Book 2 , page 77, of the
Public Records of Dade County, Florida; thence run
easterly along the southerly line of said Lot 1
Block 1, extended easterly, to the high water line
of the Atlantic Ocean; thence meander southerly along
the high water line of the Atlantic Ocean to the inter-
section of said high water line with the Northerly line
of Lot 10, Block 28, extended easterly, of the afore-
mentioned Subdivision; thence run westerly along said
northerly line of Lot 10, Block 28, extended easterly,
to the northeasterly corner of the said Lot 10, Block
23; thence northerly a distance of Seventy and Ninety-
eight One-hundredths (70.98) feet, more or less, to the
point of beginning, together with all riparian rights
appurtenant thereto.
AND ';JHEREAS, the City Council of the City of Miami Beach,
deems it to be to the best interest of the said City to acquire
said land at said price and on the terms and conditions set forth
in said offer, and
WHEREAS, the City Attorney has prepared an agreement be-
tween the parties by the terms of which the Owner and Lessee agree
to sell and the City agrees to buy said land, and
WHEREAS, the City Council is familiar with the terms of
said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the Mayor and City Clerk be and
they are hereby authorized and directed to execute the said agree-
ment in the name of and on behalf of said City, and the City Manager
be and he is hereby authorized and directed, subject to the approval
of the title by the City Attorney, to consummate the transaction
contemplated hereby, and the disbursing officers of the City are
hereby authorized and directed to make the expenditures required
to comply with the terms of saidagreement out of the funds of the
City available for such purpose.
