Resolution 7883 RESOLUTION NO. 7883 WHEREAS, a certain building has heretofore been erected upon that certain parcel of land situate in the City of Miami Beach, Florida, described as follows: Lot 23 and the easterly one (1) foot of Lot 24, Block 1, Hibiscus Island, accord- ing to the Plat thereof recorded in Plat Book 8, at Page 75 of the Public Records of Dade County, Florida; AND WHEREAS, a recent survey made by Biscayne Engineering Company reveals that the said building encroaches upon South Hibiscus Drive, said Drive being a public street of the City of Miami Beach, Florida, copy of said survey being hereto attached, and WHEREAS, it is the opinion of the City Council that the said encroachment was unintentional, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, That, insofar as said Council has the power to bind the City of Miami Beach in the premises, no action of any kind whatso- ever shall be taken by the said City to require the owners of the said property or their heirs, successors or assigns to move, or re- move, the portion of structures encroaching upon said public street as aforesaid. Also 1 foot of Lot 24, Block 1 , HIBISCUS ISLAND, more particularly described as follows, to wit; Beginning at the Northwesterly corner of Lot 23, Block 1, Hibiscus Island as recorded in Plat Book S at Page 75, of the Public Records of Dade County, Florida; thence Southwesterly along the dividing line between lots 23 and 24 a distance of 175 feet to the Southwesterly corner of said lot 23; thence Southwesterly along an extension of the dividing line between lots 23 and 24 extended in the Bay a distance of 20 feet; thence along a curve to the right parallel to and 20 feet distant from the Southerly boundary of Lot 24 a distance of 1 foot; thence Northeasterly along a line parallel to and 1 foot distant from said dividing line between lots 23 and 24 a distance of 195 feet to the Southerly line of South Hibiscus Drive; thence in an Easterly direction along the Southerly line of South Hibiscus Drive to the Point of Beginning. Said strip of land being the Easterly 1 foot of said lot 24 and the Easterly 1 foot of that pert of a 20 foot strip allocated to lot 24 in Deed recorded in Deed Book 1501 at Page 479 of the Public Records of Dade County, Florida.
