Resolution 2018-30391RESOLUTION NO. 2018 -30391 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER, PURSUANT TO REQUEST FOR QUALIFICATIONS NO. 2018 - 155 -WG, FOR A PRE - QUALIFIED POOL OF CONTRACTORS FOR STATEWIDE HOUSING INITIATIVES PARTNERSHIP PROGRAM (SHIP) REHABILITATION PROJECTS; AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH CONWELL AND ASSOCIATES CONSULTING CO., AND DELCONS, INC.; AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH EACH RECOMMENDED PROPOSER, UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS BY THE ADMINISTRATION. WHEREAS, the State of Florida has enacted legislation to allocate a portion of documentary stamp taxes on deeds to local governments, for the purpose of the development and maintenance of affordable housing; and WHEREAS, the State Housing Initiatives Partnership (SHIP) Act, §420.907- 420.9079, Florida Statutes (1992) requires local governments to develop a one to three year Local Housing Assistance Plan (LHAP), outlining the strategies jurisdictions will use to utilize funding; and WHEREAS, on January 17, 2018, the Mayor and City Commission adopted a policy governing the selection of contractors for construction projects awarded by the City, pursuant to the Statewide Housing Initiatives Partnership Program (SHIP); and WHEREAS, pursuant to the foregoing policy, the Administration was authorized to issue a Request for Qualifications (RFQ) in order to establish and maintain a pool of qualified contractors; and WHEREAS, on April 5, 2018, the City issued RFQ No. 2018- 155 -WG, fora Pre - Qualified Pool of Contractors for Statewide Housing Initiatives Partnership Program (Ship) Rehabilitation Projects; and WHEREAS, RFQ responses were due and received May 10, 2018; and WHEREAS, the City received proposals from the following two (2) firms: Conwell and Associates Consulting Co., and Delcons, Inc.; and WHEREAS, an Evaluation Committee appointed by the City Manager pursuant to LTC# 330 -2018 convened on June 27, 2018, to consider the responsive proposals received; and WHEREAS, the Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance, the Government Sunshine Law and general information on the scope of services and a copy of each proposal; and WHEREAS, the Committee was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFQ; and WHEREAS, the evaluation process resulted in the ranking of proposers as follows: Delcons, Inc as the top ranked proposer, and Conwell and Associates Consulting Co., as the second ranked proposer; and WHEREAS, after reviewing all of the submissions and the Evaluation Committee's rankings, the City Manager exercised his due diligence and is recommending that the Administration be authorized to enter into negotiations with both Conwell and Associates Consulting Co., and Delcons, Inc., to allow for the future competition of projects pursuant to the State Housing Initiatives Partnership (SHIP) program for owner- occupied construction projects funded by the Florida Housing Finance Corporation (FHFC)'s SHIP program; and WHEREAS, the firm(s) selected shall compete for future projects pursuant to the State Housing Initiatives Partnership (SHIP) program for owner - occupied construction projects funded by the Florida Housing Finance Corporation (FHFC)'s SHIP program. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the City Manager, pursuant to Request for Qualifications No 2018 - 155 -WG, for a Pre- Qualified Pool of Contractors for Statewide Housing Initiatives Partnership Program (Ship) Rehabilitation Projects; authorize the Administration to enter into negotiations with Conwell and Associates Consulting Co., and Delcons Inc.; and further authorize the Mayor and City Clerk to execute an agreement with each recommended proposer, upon conclusion of successful negotiations by the Administration. RECOMMENDATION Adopt the Resolution. ANALYSIS The State of Florida enacted the William E. Sadowski Affordable Housing Act, Chapter 92 -317 of Florida Sessions Laws, allocating a portion of documentary stamp taxes on deeds to local governments for the development and maintenance of affordable housing. The State Housing Initiatives Partnership (SHIP) Act, §420.907- 420.9079, Florida Statutes (1992), and Rule Chapter 67 -37, Florida Administrative Code, requires local governments to develop a one to three year Local Housing Assistance Plan (LHAP) outlining the strategies jurisdictions will use to utilize funding. The LHAP also establishes the maximum SHIP funds allowable for each programmatic strategy. The Office of Housing and Community Services (HCS) administers SHIP funds, participant eligibility, contractor eligibility and program compliance. HCS determines the eligibility for all applicants by assessing income and property standards. All awards are disbursed via a deferred payment loan, secured by a mortgage agreement with restrictive covenant and promissory note. On January 17, 2018, the Mayor and City Commission adopted a policy governing the selection of contractors for construction projects awarded by the City pursuant to the Statewide Housing Initiatives Partnership Program (SHIP). Pursuant to the policy, the Administration was authorized to issue a Request for Qualifications (RFQ) in order to establish and maintain a pool of qualified contractors. The policy also authorized the City Manager to approve qualifications and execute agreements with the pre - qualified contractors for project award limit authorized by the City's Local Housing Assistance Plan (LHAP). The City Manager will issue a Letter to Commission quarterly, delineating any approved bids /agreement that exceed the $50,000 threshold. Page 490 of 1464 Pre- qualified contractors shall compete for future projects pursuant to the State Housing Initiatives Partnership (SHIP) program for owner- occupied construction projects funded by the Florida Housing Finance Corporation (FHFC)'s SHIP program. Pursuant to the Local Housing Assistance Plan (LHAP), previously approved by the City Commission, the City may provide income eligible homeowners with SHIP funds in connection with repairs or improvements that are needed for safe or sanitary habitation, correction of substantial code violations, or the creation of additional living space (rehabilitation) or disaster mitigation repairs (collectively, City's Housing Rehabilitation Program). Pre- qualified contractors must maintain the licensing, insurance, and qualifications required by the City to be prequalified for future projects awarded through this procedure. RFQ PROCESS On April 5, 2018, RFQ No. 2018- 155 -WG for Pre- Qualified Pool of Contractors for Statewide Housing Initiatives Partnership Program (Ship) Rehabilitation Projects was issued. RFQ responses were due and received May 10, 2018. The Procurement Department issued solicitation notices to 932 firms utilizing www.publicpurchase.com. Forty five (45) prospective proposers accessed the advertised solicitation. The City received proposals from the following two (2) firms: Conwell and Associates Consulting Co. and Delcons, Inc. Staff believes that the reason why only two (2) responses were received is that the projects to be awarded under the SHIP program are usually under $75,000, with the vast majority being for significant lower amounts. The Evaluation Committee appointed by the City Manager pursuant to LTC# 330 -2018 convened on June 27, 2018, to consider the responsive proposals received. The Committee was comprised of Tony Gonzalez, Operations Manager, Building Department, City of Miami Beach, Justin Karr, Real Estate Asset Specialist, Tourism, Culture and Economic Development Department, City of Miami Beach, Nelson Martinez, Tenant Services Coordinator, Housing & Community Services Department, City of Miami Beach and Oniel Toledo, Construction Manager, Property Management Department, City of Miami Beach. The Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance and the Government Sunshine Law. The Committee was also provided with general information on the scope of services and a copy of each proposal. The Committee was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFQ. The evaluation process resulted in the ranking of proposers as indicated in Attachment A. A brief description of each proposer, as provided in their response to the RFQ, follows: Conwell and Associates Consulting Company (CACC) CACC began 2007 with the development of homes, churches and schools in the Miami Dade, Broward, Palm Beach, and Monroe County areas. They have produced a strategic blend of general contracting, construction expertise, quality of work, superior project management and trusted construction services; specializing in multi- family, commercial, institutional, municipal and historic renovation construction. Delcons, Inc. Delcons Inc. are construction and development professionals with over 25 years of experience in all aspects of the industry. They have a verifiable track record coordinating construction contracts, developing positive relationships with architects, engineers, vendors and clients while completing construction projects. Additionally, Delcons, Inc. was contracted by the City in 2015 to provide facility maintenance services. To date, they City has been satisfied with their performance and level of service. Page 491 of 1464 CONCLUSION The Evaluation Committee determined that both firms are qualified to perform the type of work awarded under SHIP guidelines. Having multiple vendors that can compete for work to be awarded under SHIP guidelines benefits both the City and the residents for which the work is being completed. Therefore, after reviewing all of the submissions and the Evaluation Committee's rankings, the City Manager exercised his due diligence and is recommending that the Administration be authorized to enter into negotiations with both Conwell and Associates Consulting Co. and Delcons, Inc. to provide income eligible homeowners with SHIP funds in connection with repairs or improvements that are needed for safe or sanitary habitation, correction of substantial code violations, or the creation of additional living space (rehabilitation) or disaster mitigation repairs (collectively, City's Housing Rehabilitation Program); and further authorizing the Mayor and City Clerk to execute agreements with each firm, upon conclusion of successful negotiations by the Administration.
