Resolution 2018-30406RESOLUTION NO. 2018 -30406 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE WRITTEN RECOMMENDATION OF THE CITY MANAGER (AS SET FORTH IN THE CITY COMMISSION MEMORANDUM ACCOMPANYING THIS RESOLUTION), AND WAIVING, BY A 5 /7THS VOTE, THE FORMAL COMPETITIVE BIDDING REQUIREMENT, FINDING SUCH WAIVER TO BE IN THE CITY'S BEST INTEREST, AND AUTHORIZING THE PURCHASE OF PARALLELING SWITCHGEAR EQUIPMENT FROM PANTROPIC POWER INC., IN AN AMOUNT NOT TO EXCEED $110,120.00, PLUS A 5% CONTINGENCY OF $5,506.00 FOR OTHER MINOR ITEMS THAT MAY BE NECESSARY, FOR A NOT TO EXCEED TOTAL COST OF $115,626.00, FOR THE PURPOSE OF COMPLETING THE INSTALLATION OF THE POLICE DEPARTMENT'S EMERGENCY GENERATOR REPLACEMENT PROJECT. WHEREAS, the City needs to replace /install two (2) emergency generators at the Miami Beach Police Department (the "project"); and WHEREAS, the project consists of two (2) 500kW generators, which are available via the competitively procured National Joint Powers Alliance (NJPA) 080613 - CAT award to Pantropic Power, Inc., the local dealer for Caterpillar generators, as well as a number of ancillary items (e.g., switchgears); and WHEREAS, to expedite the project, which is critical to keep the Police Station operational in the event of a storm or other catastrophe that results in loss of power to the station, the Administration issued a purchase order to Pantropic Power, Inc. under the NJPA contract, for the generators as these have a long lead time for manufacturing and delivery; and WHEREAS, the project also requires a paralleling switchgear, which is not available under the NJPA contract, but necessary to operationally connect the two generators; and WHEREAS, the Administration has researched options for procuring the paralleling switchgear and, in doing so, has secured quotes from electrical equipment and supplies dealers under contract, as well as a quote from the electrical contractor engaged to complete the installation of the generators as detailed in the accompanying City Commission Memorandum; and WHEREAS, all of the prices received exceed the City's budget for this project; and, alternatively, staff requested pricing from Pantropic Power, Inc., ( "Pantropic ") the firm supplying the two (2) Caterpillar 500kW generators for the project; and WHEREAS, Pantropic's price for the same units is $110,120.00; and WHEREAS, while the City does not have a contract for the switchgears, it is clear that Pantropic's pricing for these items is a more cost- effective solution for the City; and WHEREAS, the City's engineers of record for the project, Calvin Giordano & Associates, Inc., have advised staff that it is beneficial, from a coordination, installation and future maintenance perspectives, to purchase the switchgears from the same firm supplying the generators; and WHEREAS, accordingly, the City Manager recommends waiving, by a 5 /7ths vote, the formal competitive bidding requirement, finding such waiver to be in the City's best interest, and authorizing the purchase of paralleling switchgear equipment from Pantropic Power, Inc., in an amount not to exceed $110,120.00, plus a 5% contingency of $5,506.00 for other minor items that may be necessary, for a not to exceed total cost of $115,626.00, for the purpose of completing the installation of the Police Department's emergency generator replacement project.
