Resolution 2018-30415RESOLUTION NO. 2018 -30415 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING AS A SOLE SOURCE PURCHASE, PURSUANT TO SECTION 2- 367(d) OF THE MIAMI BEACH CITY CODE, FOR THE PURCHASE OF UTILITY SERVICES FOR THE REMOVAL OF OVERHEAD ELECTRICAL UTILITIES, INSTALLATION OF A PAD MOUNTED TRANSFORMER AND ASSOCIATED RISERS, CABLES AND FEEDERS ON THE BOTANICAL GARDENS EXTENSION, FROM FLORIDA POWER & LIGHT, ALONG THE COLLINS CANAL, WHICH IS BEING PERFORMED AS PART OF THE STORMWATER PUMP STATION ON 19TH STREET PROJECT, LOCATED BETWEEN CONVENTION CENTER DRIVE AND MERIDIAN AVENUE; FOR A NOT -TO- EXCEED AMOUNT OF $145,177; WITH PREVIOUSLY APPROPRIATED FUNDING. WHEREAS, on January 17, 2017, the City entered into a Design /Build Agreement with Ric -Man Construction, Inc. (Ric -Man) to develop, design and construct the Stormwater Pump Station on 19`h Street between Convention Center Drive and Meridian Avenue; and WHEREAS, as part of the scope of the project, Ric -Man will replace the existing seawall along the south perimeter of the Collins Canal, abutting the Miami Beach Botanical Garden (Botanical Garden) and the Holocaust Memorial properties; and WHEREAS, on September 13, 2017, the Mayor and City Commission adopted Resolution No. 2017 -30010 approving and authorizing the extension of the Botanical Garden to the Collins Canal; and WHEREAS, as part of the Resolution, the removal of existing utilities is required along the area designated for the extension of the Botanical Garden; and WHEREAS, Florida Power and Light (FPL) currently has four (4) old wooden poles, transformers and overhead and underground lines that feed the nearby neighborhoods as well as the Botanical Gardens. As such, the removal of these poles and the replacement of overhead lines, pole mounted transformers and wiring will be necessary; and WHEREAS, on March 23, 2018, the Mayor and the City Commission approved Amendment No. 2 for the Design and Construction of the extension of the Botanical Gardens, to expand the limits of the Botanical Gardens north, up to the new sea wall on the Collins Canal, to include new landscape, irrigation, walkways, gates, railings, benches, planters and improved lighting; and WHEREAS, FPL proposed the removal of the old wooden poles, the installation of two, new self- supported concrete poles, away from the area designated for the seawall construction extension of the Botanical Garden, a pad- mounted transformer, associated risers, feeders, cables and duct banks; and WHEREAS, FPL is the sole source provider for the services contemplated herein; and WHEREAS, pursuant to section 2- 367(d), the city may use a sole source bid upon recommendation of the City manager and four (4) affirmative votes by the City Commission; and WHEREAS, on July 6, 2018, FPL submitted a negotiated proposal in the amount of $145,177; and WHEREAS, the cost proposal was reviewed and analyzed by the Office of Capital Improvement Projects and Public Works Engineering and was found to be fair and reasonable considering the accelerated schedule and complex logistics of construction. NOW, THEREFORE, BE - IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission approve and authorize as a sole source purchase, pursuant to section 2- 367(d) of the Miami Beach city code, for the purchase of utility services for the removal of overhead electrical utilities, installation of a pad mounted transformer and associated risers, cables and feeders on the Botanical Gardens extension, from Florida Power & Light, along the Collins Canal, which is being performed as part of the stormwater pump station on 19th Street Project, between Convention Center Drive and Meridian Avenue; for a not -to- exceed amount of $145,177; with previously appropriated funding.
