A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY ADMINISTRATION TO
NEGOTIATE AN INTERGOVERNMENTAL AGENCY AGREEMENT WITH MIAMI-
DADE COUNTY, WHICH WOULD PERMIT THE INSTALLATION AND
MAINTENANCE OF LICENSE PLATE READERS AND TRAFFIC MONITORING
CAMERAS ON PUBLIC RIGHTS OF WAY OWNED, OPERATED OR MAINTAINED
BY MIAMI -DADE COUNTY IN ORDER TO ENHANCE THE SAFETY AND WELL-
BEING OF THE RESIDENTS OF THE CITY OF MIAMI BEACH; AND FURTHER
AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE
AGREEMENT UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS,
PROVIDED THAT THE TERMS AND CONDITIONS ARE ACCEPTABLE TO THE
CITY MANAGER AND CITY ATTORNEY.
WHEREAS, the City of Miami Beach (the "City ") deployed its first License Plate Reader ( "LPR ") in
2013, recognizing that this advanced technological device would help increase the safety and well -being
of the City's residents and visitors; and
WHEREAS, the City currently has ten (10) LPR mobile units, one (1) LPR trailer and five (5) LPRs
at fixed locations within the City, which have proven to be invaluable assets to the Miami Beach Police
Department (the "Police Department ") for the interception of criminal subjects entering the City and in
providing critical investigative leads in unsolved crimes; and
WHEREAS, the Police Department has identified twenty -eight (28) additional locations for the
placement of LPRs and traffic monitoring cameras, which would provide the Police Department the
necessary enhanced coverage to identify those vehicles that may be involved in criminal conduct; and
WHEREAS, pursuant to Section 2 -96.1 of the Code of Metropolitan Dade County, Florida, all traffic
control devices and traffic engineering services in Miami -Dade County are under the sole jurisdiction of
Miami -Dade County; and
WHEREAS, an Intergovernmental Agency Agreement with Miami -Dade County must be executed
in order to authorize the City to install and maintain LPRs and traffic monitoring cameras within the
territorial jurisdiction of the City of Miami Beach upon those public rights of way owned, operated or
maintained by Miami -Dade County.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby authorize the City
Administration to negotiate an Intergovernmental Agency Agreement with Miami -Dade County, which
would permit the installation and maintenance of License Plate Readers and traffic monitoring cameras on
public rights of way owned, operated or maintained by Miami -Dade County in order to enhance the safety
and well -being of the residents of the City of Miami Beach; and further authorizing the City Manager and
City Clerk to execute the agreement upon conclusion of successful negotiations, provided that the terms
and conditions are acceptable to the City Manager and City Attorney.

ANALYSIS
The City of Miami Beach began the deployment of License Plate Readers (LPRs) in 2013,
recognizing that this advanced technological device would help increase the safety and well -being of
the City's residents and visitors.
LPRs capture images of license plates as vehicles drive through an area where the LPRs are
temporarily or permanently installed. The information collected is then compared against DMV
records and local, state and federal databases. When the databases identify a license plate
associated with a vehicle law enforcement officials are looking for, a "hit" is generated and officers
automatically receive a notification. Additionally, detectives can manually enter license plate numbers
and pull up all past images of a specific captured plate, which is particularly helpful for cases related
to criminal investigations, stolen vehicles, amber alerts and sexual exploitation. In addition to allowing
for live viewing of traffic conditions and facilitating the management of traffic during special events,
traffic monitoring cameras record and provide further investigative leads, such as details concerning
the vehicles make and color, number of passengers in the car, etc.
Currently, the City utilizes 10 LPR mobile units, 1 LPR trailer, and 5 LPR devices at fixed locations.
This deployment has proven to be an invaluable asset, allowing officers to intercept criminal subjects
as they enter the City and providing critical investigate leads of unsolved crime. For instance, over
the 2018 Memorial Day Weekend, the 5 nights of activity on both causeways resulted in 45,262 tags
read, 11 felony arrests, and 44 misdemeanor citations /arrests. The following cases, among others,
also show the benefits of LPRs effectively:
• March 28, 2015 — During an LPR detail at the 41st Street corridor, an alert for a "possible

terrorist." The vehicle was located and a traffic stop was conducted. The driver was positively
identified by the FBI as a subject they had been surveilling for a lengthy period of time. As a
result of the traffic stop, the FBI obtained a search warrant for the subject's apartment and
found a fully loaded Kel -Tec Assault rifle with a collapsible stock and two addition 30 round
magazines along with an additional 200 rounds of ammunition. The subject was charged
federally for possession of a firearm by a convicted felon.
• February 21, 2016 —An LPR stolen vehicle alert was received for a 3 door gold Chevrolet with
an Ohio tag. The vehicle was stopped at 5th Street and Michigan Avenue. The vehicle's
occupants were taken into custody. A search of the vehicle revealed a very large amount of
ammunition, firearms, and narcotics. The subject stated that they were intending to rob people
at the beach.
• March 14, 2018 — Officer Calderin received a LPR hit on a stolen vehicle coming eastbound on
the Macarthur Causeway. Vehicle was stopped in the 600 block of Pennsylvania Ave and the
passengers fled on foot. Officer Calderin apprehended the driver and additional responding
units located the passenger hiding in a nearby parking garage. The driver had a loaded 40
caliber semi - automatic handgun inside his right pants leg and 4.4 grams of marijuana in his
pocket. The firearm was reported stolen and the passenger had two bench warrants.
The Miami Beach Police Department has identified 28 additional locations that would provide
sufficient coverage of vehicles traversing the major thoroughfares of the City. Pursuant to Section 2-
96.1 of the Miami -Dade County Code, however, all traffic control and traffic engineering services in
Miami -Dade County are under the sole jurisdiction of the County. As such, all traffic control devices
along state roads within Miami -Dade County are under the exclusive maintenance and operation of
the County.
To install additional LPRs, the City of Miami Beach therefore needs to execute an Intergovernmental
Agency Agreement (IAA) with Miami -Dade County giving the City of Miami Beach the authority to
install and manage these LPRs on or along public right of way or infrastructure operated or
maintained by Miami -Dade Country.
A portion of the LPR expansion project is funded in the Police Department's current general fund
budget. The remaining portion is included in the G.O. Bond request. Should the referendum not
pass, the City will seek alternative funding.
We are asking the City Commission to authorize the development and execution of this IAA.
