WHEREAS, there is now pending in the Circuit Court of the
Eleventh Judicial Circuit of Florida, in and for Dade County, a cer-
tain cause wherein LAURA GOLDSTEIN, as the widow of E. Max Goldstein,
Plaintiff, and CITY OF MIAMI BEACH, ALFRED DESTIN CO. , and others,
are defendants, in which cause the plaintiff seeks to recover from
the d efendants the sum of 500,000.00 as damages on account of the death
of the late E. Max Goldstein, and
WIMREAS, there is also pending in said Court that certain
cause wherein MORRIS KLEIN is plat ntiff and CITY OF MIA I BEACH, ALYR:�D
DESTIN CO. , and others, are defendants, wherein the plaintiff seeks
damages in the sun of f?50,000.00 on account of injuries sustained in
the identical accident in which the said E. Max Goldstein met his death,
and
WHEREAS, extended negotiations have resulted in an offer by
the plaintiffs to settle the Goldstein case for the sum of ;115i000.00
and to settle the Klein case for the sum of =;12,300.00 which said sins
1 in the aggregate amount to the sum of ;„127, 300.00 of which the said
Alfred ?gestin Co. , and its insurer are willing to pay the sum of
` 77,300.00 provided the City of Miami Beach contributes toward said
settlement the sum of ; 50,000.00, and
WHEREAS, the City Council deems it to be to the best interest
of the City of Iliami Beach to make such settlement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIA-`I BEACH, FLORIDA, that the disbursing officers of the
City be and they are hereby a thorized and directed to pay, in con-
, sideration of the full satisfaction of all claims of said plaintiffs
and co-defendants, the sum of v50,000.00 out of funds of the City
available for such A,urnose.
BE IT FURTHLi RESOLVED that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute, in the name
of and on behalf of said City, such releases as may be satisfactory to
the said co-defendants, Alfred Uestin Co. , and others, and the insurer
or insurers of then, or any of them.
