Resolution 7952 RESOLUTION NO. 7952
WHEREAS, a building has heretofore been erected upon that
certain parcel of land situate in the City of Miami Beach,
Florida, described as follows :-
Lot Five (5) of Block Twenty-two (22)
of ALTOS DEL MAR NO. 1, according to
the Plat thereof, recorded in Plat Book
31, page 40, of the Public Records of
Dade County, Florida,
AND WHEREAS, Ordinance No. 289, commonly known as the
"Zoning Ordinance of the City of Miami Beach" requires that
there be a side yard of not less than five (5) feet on either
side of a building erected upon said property, and a rear yard
of not less than five ( 5) feet, and
WHEREAS, on April 18, 1948, a survey of said property was
made by Biscayne Engineering Company, Civil Engineers, a copy of
which survey is hereto attached, which survey reveals said
building encroaches approximately 1.65 feet on that portion of
the land which should be a rear yard and encroaches slightly upon
that portion of the land which should be a side yard on the north
side thereof.
NOW, THEREFOR: , BE IT :tESOLVED by the City Council of the
City of Miami Beach, that insofar as the City Council has the
power to bind the City of Miami Beach, Florida, in the premises,
no action of any kind whatsoever shalbe taken by said City to
require the owners of said above property, their heirs, successors
or assigns , to move or rer.,ove that portion of the structure en-
croaching upon saidrear yard and said side yard.
