Resolution 8302 RESOLUTION NO. 8302 WHEREAS, the City of Miami Beach deems it advisable to arrange for a twenty-four hour a day ambulance service for the public within the corporate limits of the City, and WHEREAS, the City Manager has negotiated a contract with Beach Memorial Chapel, Inc . , Gordon Funeral Home, Inc . , Hellman Funeral Chapels, Inc . , Niceley Funeral Home, Inc . , Riverside Memorial Chapel, Miami Beach, Inc . , and Walsh & Wood Funeral Irome, Inc . for such ambulance service, and `T REAS, the results of such negotiations between the City Manager and the said funeral homes have been reduced to writing and placed, by the City Attorney, in the form of an agreement between said funeral homes and the City, and the City Council being familiar with the terms of said agreement, and 'REAS, the City Council deems it to be to the best interest of said City to enter into said agreement, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the Mayor and the City Clerk be and they are hereby authorized and directed to execute the said agreement in the name of and on behalf of said City. RIVER- SIDE 1R/AL CHAPEL, NMAMI BEACH, INC . : and WALE* i WOOD FUNERAL HOME, INC . ; each of which is a Florida Corporation, hereinafter called the .,atm" WITNESSETH: WHEREAS, The City deems it advisable to arrange for a twenty--Pour hour a day ambularuos service for the public within the boundaries of the City, notwithstanding that there is no public ambulance in said City, and WHEREAS, the Operators own and operate ambulances provided with skilled drivers and attendants and the Operators are willing to provide the service desired by The City, on behalf of its citizens and inhabitants, NOW, THEREFORE, in consideration of the sum of $1 .00 paid to each of the Operators by The City, receipt of which is acknowledged, it is mutually agreed as follows 1 . That this agreement shall be effective and shall continue from until midnight of the anniversary of the effective date hereof . 2 . That each of the Operators will provide and place and maintain on duty at all times at least one (1) ambulance, specially designed, equipped and prepared for the transportation of sick end injured persons and each of said vehicles shall have on hand, available at the place where each of the ambulances shall be kept, a skilled driver and trained attendant, the latter of whom shall have satisfied a Medical officer appointed by The City for that purpose that he has reeseived adequate first aid training, at least compsrale to that offered by the haerisan Red Cross Society. 3 . Each of said ambulances shall at all time be equipped with a siren, omen tank, masks and other appliances needed to administer oxygen enroute to passengers, stretchers, first aid kits completely outfitted at all times, reseseitator, and red lights, all of which appliances and equip- ment must be and shall be kept in good working order at all times. 4. That each of said ambulances shall be insured against "public lia- bility ia- bitity to the extent of $50,000.00 for one injury jury and $100,000.00 for several Injuries growing out of the same accident, and $5,000.00 property damage . The contract of insurance providing such insurance shall be writ- ten in companies satisfactory to The City and shall provide for continuance in full force until not less than five (5) days after notice to The City of cancellation thereof, to the end that The City may at all times be as- sured that insurance coverage as required is in effect . 5 . Calla for ambulance service which must be recognised and *esepted by an Operator may be made (a) by a Police Dispatcher losated at the Police Station, or (b) emergency calls by any citizen, provided he shall give his name and address and state the nature of the need for ambulance service at the time the service is requested. In the event any emergency call, other than a call from the Police Dispatcher is recognized and accepted by an Operator or the Operators, the Police Dispatcher shall be not if Zed forthwith. Each ambulance upon return- ing from a call shall immediately notify the Police Dispatcher. All calls for ambulance eerrice made by the Dispatcher at Police Headquarters shall be promptly accepted and honored and the Dispatcher's authority to ask for ambulance service Shall be recognized at all times. 6. No Operator shall at any time convey any sick or injured person to any place against the will of such person, provided, that if any sick or injured person is unable to give direetion in his own behalf, direction as to destination shall be taken from an immediate relative, if any be present, and, If there be none such available, such sick or injured person shall be conveyed to the nearest regularly licensed hospital which will accept him. -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA • 7, The City shall pay to the Operators $10.00 for each trip or call made within the boundaries of The City; if a sick or injured person is transported from a point within the City to a point outside the City and within Dads County, Florida, The City shall pay the Operators the sum of $15.00; if a sick or injured person is carried from a point within the City to a regularly licensed hospital within the limits of the City and then transported to a point outside the limits of the City and within Dade County, Florida, The City shall pay the Operators the sum of $25 .00 ; in the event oxygen is administered enrouto to a sick or Injured poison The City Spall pay the Operators $5.00 for oath tank of oxygen consumed. 8. Provided, however, none of the payments above set forth shall be made by The City to an Operator unless the Operator has submitted a bill to the sick or injured person transported within mei! 'olio after ren- derirg the service and shall have furnished the City Clerk gift a copy thereof by mailing the same on the day the bill is transmitted to the sick or Injured person and thereafter in the event the Operator is not paid for its charges by the sick or injured person transported within thirty (30) days after rendition of service, the Operator Shall notify The City Clerk of the City of Miami ]leach, whose duty it will be to pro- cess the charge for payment and secure payment of the charge not later than sixty (60) days after the rendition of servioe; provided further, however, that the City shall under no circumstances be liable x"or the pay- ment of anything whatsoever except for ambulance sertices rendered as a result of a call by the Dispatcher at Felice aeadgearters. Provided fur- ther, when the Dispat hir at Police Headquarters requests ambulance service and the Operator provides and sends an ambulatese to the point indicated the Operator shall receive a fee of $1Q.00, even though the sick or injured' person refused to be transported in the Orator'a ambulance . 9. This contract is intended to cover only services rendered when the sick or injured person is in need' of Immediate transportation and when the absence or lack or such transportation may endanger the chance of recovery of the sick or injured person or the delay incident to secur- ing a private ambulance may be da Brous to the life or well-being of the sick or in j sued person requiring ambulance sery ice .
