Resolution 8473 RESOLUTION NO . 8473
WHEREAS, William L . Greenfogel and Sarah Greenfogel, his wife ,
have heretofore offered to convey for the purpose of street widen-
ing the easterly 22 feet of that certain parcel of land situate
in Miami Beach, Dade County, Florida, described as follows, to-wit:
Lot 6, Block 29, ALTOS DEL MAR f#3,
and the closed portion of 76th Street
immediately south thereof, as shown on
Plat thereof, recorded in Plat Book 8,
at page 41, of the Public Records of
Dade County, Florida,
if the City of Miami Beach would agree that no assessment would be
made against said land for paving, sidewalks, curbing and lights ,
and
WHEREAS, the City Council has heretofore evidenced its will-
ingness to enter into a similar agreement with the said owners as
well as other owners of land similarly located, in order to ac-
complish the desired street widening, and
WHEREAS, it recently became necessary for the said owners
to place a mortgage upon the said land, the mortgageprequiring a
deposit of $700 .00 to be left in escrow against the lien of the
City for the paving, sidewalks , curbing and lights which would
ensue, and
WHEREAS, the City Manager deemed it to be to the best in-
tereSt of the City to relieve the said owners of the burden of
allowing said sum of $700 .00 to remain with the escrow agent for
an indefinite period of time until the liens for paving, sidewalks,
curbing and lights could be certified and paid off by the City, and
the City Manager deposited on behalf of the City the sum of $700 .00
with the escrow agent upon the condition and with the understand-
ing that said $700 .00 would be returned to the City if, as and
when the liens heretofore mentioned are fully paid off and certi-
fied and evidence thereof furnished to the escrow agent .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the acts of the City Manager
as herein set forth be and the same are hereby ratified and con-
firmed.
