Resolution 8496 RESOLUTION NO. 8496 WHEREAS, the United States of America through its War Assets Administrator did, on or about the 3rd day of January, 1949, de- liver to the City of Miami Beach, Florida, a duly executed quit- claim deed bearing said date and conveying to said City property situated in Miami Beach, Florida, and known as the NAUTILUS VETERANS ADMINISTRATION HOSPITAL property which property so conveyed included an island in Biscayne Bay known as COLLINS ISLAND, and WHEREAS, Condition (8) of said quitclaim deed provides certain things to be done within 1 months after the date of said quitclaim deed, and WHEREAS, said 18 months limitation was extended to 60 months from the date of the deed by a letter from the War Assets Adminis- trator dated May 16, 1949, and WHEREAS, Conditions (1 ) , (2) , (3) , (4), (5) and (10) of said deed provide that for a period of 20 years from the date of the said deed the City of Miami Beach would do certain things and re- frain from doing certain things, all as set forth in said Conditions, and by the terms of said Conditions certain reciprocal rights and duties are created for said term of 20 years, and WHEREAS, Mt . Sinai Hospital of Greater Miami, Inc . , a non- profit corporation, has heretofore entered into a managerial con- tract with the City of Miami Beach wherein and whereby the said Mt . Sinai Hospital of Greater Miami, Inc . , assumed all the obliga- tions imposed upon the City of Miami Beach by the provisions set , forth in the quitclaim deed heretofore described, and WHEREAS, the Board of Trustees of Mt . Sinai Hospital of Greater Miami, Inc . , have petitioned the City of Miami Beach to request the United States of America, through the Federal Security Agency, to extend the time for performance of the conditions of Condition (8) of the said deed for 36 months from the date of present limitation (January 3, 1954) , or until January 3, 1957, and WHEREAS, the City Council of the City of Miami Beach deems it to be to the best interest of said City to request the said exten- sion of time . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami Beach, Florida, that the United States of America be, and they are, hereby requested to extend the time for performance of Condition (8) of said quitclaim deed until January 3, 1957 • BE IT FURTHER RESOLVED that if such extension is granted, then as respects Collins Island, the period of 20 years fixed under Conditions (1 ) , (2) , (3) , (4) , (5) and (10) respectively, of the said quitclaim deed shall be extended for an additional 3 years or for such portion thereof as shall be required by the City of Miami Beach for the performance of the conditions contained in Condition (8) of said deed, and the right of the United States of America to enter and re-vest title as provided for in Condition (10) of the said deed, shall be extended for an additional term of 3 years beyond 21 years from the date of the deed .
