Resolution 8509 RESOLUTION NO. 8509
WHEREAS, Orville T. Rothwell, a City Employee of the Police
Department of the City of Miami Beach, Florida was injured in the
course of his employment on September 18, 1951, as a result of a
collision with a privately owned automobile, and
WHEREAS, under the provisions of the Workmen' s Compensation
Law of the State of Florida the said City Employee has accepted
compensation and medical benefits in the sum of ,,x610.67 which
sum has been expended by ,he City of Miami Beach, and
WHEREAS, under the provisions of the said '.lorkmen's Compen-
sation Law the City of Miami Beach is subrogated to the rights
of the said employee against the third party tort-feasor, and
WHEREAS, the City of Miami Beach was caused to expend the
sum of 474.22 for the repair of its property, to wit: the motor-
cycle which was damaged at the time of the said collision, and
1HEREAS, it appears that the third party responsible for the
injuries to the said City Employee and for the damage to the
property of the City of Miami Beach has offered to compromise
and settle the claim of the City of Miami Beach for reimbursement
of compensation paid and medical benefits furnished to the said
City Employee for a consideration of500.00 and the said third
party has offered to reimburse the City of Miami Beach in full
for the amount expended by the said City to repair the damage to
the said motorcycle;
NOW THEREFORE, BE IT RESOLVED by the City Council of the
Ci .y oP Miami Beach, Florida that it is to the best interests
of the City of Miami Beach that the offer to compromise and
settle the claim for reimbursement of compensation paid and medi-
cal benefits furnished to City employee Orville T. Rothwell_, for
a consideration of , 500.00 be accepted together with the full pay-
ment of • 74.22 or repair of the damage to the property of the
City of Miami Beach as a result of the accident of September 18,
1951.
BE IT FURTHER RESOLVED that the Mayor or Vice Mayor of the
City of Miami Beach is hereby authorized to execute in the name
of the City of Miami Beach an instrument releasing the third
party, Charles A. Ravikio, from all liability by reason of that
certain accident on September 18, 1951 for t e consideration of
574.22.
