Resolution 8542 RESOLUTION NO. 8542
WHEREAS, the City Council of the City of Miami _leach deems
it to be necessary to increase the width of that portion of
Indian Creek Drive lying between 39th Street and frith Street,
and
WHEREAS, in order to increase the width of Indian Creek
Drive as aforesaid , it will be necessary to ac ['lire from the
owners thereof the strip of land lying between Indian Creek
Drive and Indian Creek extending from 39th Street to 44th Street,
and
:JHEREAS, IRA H. GOTTLIEB and others, the owners of that
portion of said strip lying westerly of and opposite to Lots
13 and 14 of Block 38 of the OCEAN FRONT PROPERTY of the Niami
Beach Improvement Company, has delivered to the City Clerk a
warranty deed conveying said portion of said strip of land to
the City subject to the terms of and in consideration of an
agreement heretofore prepared by the City Attorney and exe-
cuted by the said owner, with the terms of which said agreement
the City Council is familiar, and
':7HEREAS, the City Council deems it to be to the best in-
k terest of the City to acquire said land on the terms and in
the manner set forth in the agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the
City of Miami Beach, Florida, that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute said
agreement in the name of and on behalf of said City.
BE IT FURTHER RESOLVED that the City Manager and the City
Clerk be and they are hereby authorized and directed to carry out
the terms of said agreement for and in behalf of said City and
the disbursing officers of the City be and they are hereby autho-
rized and directed to pay out such sums of money as the City is
obligated to pay out under the terms of said agreement from the
funds of said City available for such purpose.
