RESOLUTION NO. 8565
.IHEEAS, the City of Miami Beach has heretofore entered into
a contract with Morris Barocas and Sarah Barocas, his wife, under
date of September 24, 1953 wherein the said City agreed to pur-
chase a portion of Lot 231 of FIRST OCEAN FRONT SUBDIVISION, and
iHEREAS, prior to the execution of said agreement it was
understood and agreed that if , as and when the said City paved
or installed sidewalks or other municipal improvements over,
upon or across said portion of said lot, no assessment would be
Made by the City against the remainder of said Lot 231, and
:WHEREAS , said agreement failed to contain such a covenant
on the part of the City, and
WHEREAS, a supplemental agreement has been prepared with the
contents of which the City Council is familiar, by the terms of
which the City now agrees to forego any liens for such municipal
improvements,
NOW, THtEFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida that the Mayor and the City Clerk
be and they are hereby authorized and directed to execute said
supplemental agreement in the name of and on behalf of said City.
PASSED and ADOPTED this 4th day of November, 1953.
