Resolution 8667 RESOLUTION NO. 8667
WHEREAS, ESTHER MILLER; J. N. MORRIS, as
Ancillary Administrator of the Estate of Selig Miller,
deceased; RAYS M. WEADT (formerly RAYE M. EDELSON) ; BEATRICE
Ti.SLABOVITZ and HILDA 17. ATBRAT`SON are willing to sell to the
City of Miami Beach, for the sum of Fifty Thousand, Nine Hundred
(1,50,900) Dollars in cash, that certain parcel of land situate
in Miami Beach, Dade County, Florida, described as follows,
to wit:
That certain parcel of land lying easterly
of the northerly thirty-five (35) feet of
Lot Five (5) , Block Eight (8) , of the OCEAN
FRONT PROPERTY OF THE MIAMI BEACH IMPROVE/MT
COMPANY, as shown on the amended map thereof,
recorded in Plat Book Five (5) , Pages Seven ( 7)
and Eight (8) of the Public Records of Dade
County, Florida, bounded as follows:
Bounded on the westerly side by the easterly
line of Miami Beach Drive.
Bounded on the easterly side by the Atlantic
Ocean.
Bounded on the northerly side by a line drawn
easterly from the most northerly point of said
Lot Five ( 5) , parallel to the southerly line
of said Lot Five (5) .
Bounded on the southerly side by a line parallel
to and thirty-five (35) feet southerly of the
above described northerly boundary.
As said Lot and Block are shown on the above
mentioned Plat.
Together with all common law and statutory
riparian and water rights appurtenant and
adjacent thereto.
AND WHEREAS, the City Council of the City of
Miami Beach deems it to be to the best interest of the said
City to acquire said land at said price and on the terms and
conditions set forth in said offer, for public park purposes; and
WHEREAS, the City Attorney has prepared an
agreement between the parties, by the terms of which the Owners
agreeto sell and the City agrees to buy said land; and
WHEREAS, the City Council is familiar with
the terms of said agreement,
NOW, THEREFORE, BE IT R.E,SOLVL,D by the CITY
COUNCIL OF THE CITY OF MIA MIAM BEACH, FLORIDA, that the Mayor
and City Clerk be and they are hereby authorized and directed
to execute the said agreement in the name of and on behalf
of said City, and the City Manager be, and he is herebyene title
authorized and directed, subject to the appof
OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA
by the City Attorney, to consummate the transaction r,o-1 ternplated
hereby, and the disbursing; officers of the City are hereby
authorized and directed to make the expenditures required to
comply with the terms of said agreement out f the funds
of the City available for such purpose.
