Resolution 8717 RESOLUTION NO. 8717
WHEREAS, the owners thereof have offered to convey to
the City of Miami Beach a portion of Lots 13 and 14, Block 5,
BEACH BAY SUBDIVISION, in order that a sidewalk may be
constructed on that portion of Harding Avenue upon which the
said land abuts; and
WHEREAS, the City of Miami Beach has heretofore
agreed, in consideration of said conveyance, to meet the entire
cost of highway paving, curb and gutter, sidewalk construction
and White Way light installation adjacent to said land; and
WHEREAS, in connection with a recent mortgage
loan obtained by the owners of said land, there was retained,
out of the proceeds of said mortgage loan by the escrow
agent for the mortgagee, the sum of .x:1722.00, which sum was
to be paid over by said escrow agent to said owners upon the
discharge, satisfaction or release of any claims of lien,
pending or certified, by the City of Miami Beach on account
of said municipal improvements; and
WHEREAS, it is deemed to be to the best interests
of. said City to relieve the said owners of the burden of
being required to permit said sum of $1722.00 to remain with
the escrow agent for an indefinite period of time, until the
liens for said municipal improvements can be certified and
paid off by the City; and
WHEREAS, the City Attorney has prepared an
agreement in connection with said transaction, with the terms
of which the City Council is familiar;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor
and the City Clerk be, and they are hereby authorized and
directed to execute said agreement in the name of and in behalf
of said City.
BE IT FURTHER RESOLVED that upon the execution
and delivery of said agreement by the said owners, and the
delivery to the City Attorney of a conveyance of the portion
of said lands to be conveyed by the owners to the City as
aforesaid, the City Manager be and he is hereby authorized
to make the disbursements called for by the terms of the
said agreement out of the funds of the City available for
the said purpose.
