Resolution 8733 RESOLUTION NO. 8733
WHEREAS, on the 12th day of October, 1953 the
CITY OF MIAMI BEACH entered into a contract with HIGGINS,
INC . , a Florida corporation, for sanitary sewer replace-
ment in LaGorce Drive from 60th Street to 63rd Street,
the said contract requiring the said Higgins, Inc . to
commence work on said project on or before October 22,
1953, and
WHEREAS, shortly after the execution of the
contract, the City desired to postpone the contemplated
work until the Spring of 1954 and requested said Higgins,
Inc . to so postpone it, and
WHEREAS, it is now inconvenient for the City
and Higgins, Inc. to proceed with the contemplated work
and it is the desire of both parties to said contract to
enter into a cancellation agreement, and
WHEREAS, the City Attorney has prepared an Agree-
ment which cancels and nullifies the contract of October 12,
1953, the City Council being familiar with the terms of said
Agreement .
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach that the Mayor and City Clerk be
and they are hereby authorized and directed to execute said
Agreement of cancellation in the name of and on behalf of
said City.
