Resolution 8740 RESOLUTION NO. 8740
.HEREAS, IRVINE NATHANSON AS TRUSTEE has submitted to
the City Council of the City of Miami Beach, Florida, for
approval a Plat of BAY IANCOLN SUBDIVISION, which Plat is a
Resubdivision of the South five (5) feet of Lot 3, and all of
Lots 4 and 5, Block 43, ALTON BEACH REALTY CO. ' S PLAT OF
ALTON BEACH BAY FRONT, as recorded in Plat Book 4, page 125
of the Public Records of Dade County, Florida; and
WHEREAS, the said Plat contains a. dedication to the
public for the road and street and planting, trees and
shrubbery thereon; and
WHEREAS, Chapter 25519, Laws of Florida, 1949, as
amended, prescribes that a Resolution of approval by the City
Council is a prerequisite to the filing for record of the said
Plat; and
WHEREAS, the said IRVING NATHANSON AS TRUSTEE should
construct or cause to be constructed within a reasonable
time a certain street, sidewalks, sanitary sewers, storm
sewers and other necessary drainage facilities as set out
in the said Plat, in accordance with specifications prescribed
by the City Engineer, and the said IRVING NATHANSON AS TRUSTEE
should maintain the said construction for a period of not less
than one (1) year; and
WHEREAS, the said Chapter 25519, Laws of Florida 1949
as amended provides for the furnishing of a bond for the said
construction and maintenance of the aforesaid street, sidewalks,
sanitary sewers and other drainage facilities;
NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the said IRVING
NATHANSON AS TRUSTEE is hereby directed to furnish the said
constructi:-n and maintenance bond in the amount of . 10,000.00,
which bond shall be subject to the approval of the City
Attorney.
BE IT FURTHER RESOLVED by the CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Plat of the said :AY
LINCOLN SUBDIVISION be approved, and the said dedication be
accepted by the City Council of the City of Miami Beach,
Florida, and the Mayor and the City Clerk be and they are hereby
authorized to execute the approval of the said Plat and the
acceptance of the said dedication in the name of and on behalf
of the said City, upon the furnishing of the said construction
and maintenance bond.
