RESOLUTION NO. 8755
WHEREAS, the City Council of the City of Miami
Beach deems it to be necessary to increase to One Hundred
Twenty-five (125 ' ) feet the width of that portion of Collins
Avenue adjacent on the west to Lot "A" of Indian Beach Cor-
poration' s Subdivision, according to the Amended Plat there-
of recorded in Plat Book 8, at page 61, of the Public Records
of Dade County, Florida, and
WHEREAS, in order to increase the width of Collins
Avenue as aforesaid, it will be necessary to acquire an ease-
ment for highway purposes over, under and across that certain
unnumbered out-lot" lying between Collins Avenue and Indian
Creek and opposite said Lot "A" , as well as to acquire, bulk-
; head and fill additional submerged lands in Indian Creek, and
WHEREAS, CHARNOFREE CORPORATION, the Owner of said
Lot "A" and said unnumbered "out-lot" has indicated its will-
ingness to deliver to the said City a Deed of Dedication cover-
ing said unnumbered "out-lot", and
WHEREAS, the City Attorney has prepared an Agreement
setting forth the terms and conditions upon which said Owner
will deliver such Deed of Dedication, and
WHEREAS, the City Council deems it to be to the
best interest of the City to acquire said land on the terms
and in the manner set forth in the agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the
City Clerk be and they are hereby authorized and directed to
execute said agreement in the name of and on behalf of said
City.
BE IT FURTHER RESOLVED that the City Manager and
the City Clerk be and they are hereby authorized and direct-
ed to carry out the terms of said agreement for and in be-
half of said City and the disbursing officers of the City
be and they are hereby authorized and directed to pay out
such sums of money as the City is obligated to pay out under
the terms of said agreement, from the funds of said City
available for such purpose .
