Resolution 8777 RESOLUTION No. 8777 WHEREAS, on the 29th day of October, 1952, WILLIAM J. HARVIN, an employee of the City of Miami Beach, Florida, while on duty as such employee, suffered injuries to himself and damages to the motor- cycle which he was riding by reason of a collision with an automobile driven 'oy either one SAM ROSE or :ULDRED W. ROSE, his wife; and WHEREAS, the City of Miami Beach, under the Workmen' s Compensation Act, has paid to said WILLIAM J. HARVIN on account of said injury, for hospitalization, compensation and medical expenses, various sums which, together with the cost of repairing said m o torcycle, amounts to the sum of ;767«03; and WHEREAS, said employee, through his attorney, IRVING J. CYPEN, saw fit to look to the taird party for his damages; and WHEREAS, recovery has been had against said third party, without cost to the City, and a request has been made to the City by said SAN ROSE and 1IILDREll W. ROSE,his wife, for a full release to be delivered upon the payment by said SAM ROSE and MILDRED W. ROSE, his wife to said City of the said sum of .;;767.03; and WHEREAS, a release has been prepared, with the terms of which the City Council is familiar; NOW, THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF `L'HE CITY OF MIAMI BEACH, FLORIDA, that Ghe Mayor be and he hereby is authorized and directed to execute in triplicate the said release —n the name of and on behalf of said City.
