Resolution 8792 RESOLUTION NO. 8792
WHEREAS, the I. and J. Co. , Inc. of which S. E. Schwartz, is
President and Ruth Schwartz is Secretary, has submitted to the
City Council of the City of Miami Beach, Florida, for approval, a
plat showing a resubdivision of Lot 33 in Block 10, of Biscayne
Point, as shown and recorded in Plat Book l4 at page 35 of the
Public Records of Dade County, Florida, and
WHEREAS, although the area designated on said plat as
"Private Street" is thereon dedicated to the use and enjoyment of
only the owners of the Tracts in said subdivision, said plat also
provides that the City of Miami Beach, the County of Dade, the
State of Florida, the United States of America (or any political
subdivision of any of them) shall have the right at all times
to use said street in the performance of their official functions , and
further grants to the said City of Miami Beach, or any utility
company having a franchise to operate in the City of Miami Beach,
the right to install where necessary any public utilities in said
"Private Street", for the use of the owners of said Tracts in
said Subdivision, and
WHEREAS, it is further provided on said plat that the lawful
zoning regulations as now in effect or as same may from time to
time be lawfully changed or amended applicable to the area covered
by this plat, will be observed, and
WHEREAS, Chapter 25519, Laws of Florida, 1949, as amended,
prescribes that a Resolution of Approval by the City Council is
a prerequisite to the filing for record of the said Plat,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Miami Beach, Florida, that the Plat of the said I. and J.
Co. , Inc . , as hereinbefore described, be approved, and the provi-
sions thereon with reference to the said "Private Street" and with
reference to zoning, be accepted by the City Council of the City
of Miami Beach, Florida, and the Mayor and the City Clerk be and
they are hereby authorized to execute the approval of said plat
and the acceptance as indicated herein, in the name of and on
behalf of the said City.
