Resolution 8817 RESOLUTION NO. 8617
WHEREAS, a structure has heretofore been erected
upon that certain parcel of land situate in Miami Beach, Flo-
rida, described as follows, to-wit :
Lot 2 and No . 5 feet Lot 1,
Block 68, Commercial Subdi-
vision of The Alton Beach
Realty Company, Plat Book 6,
Page 5, Dade County, Florida,
and
WHEREAS, a recent survey prepared by M. B. Garris,
Registered Civil Engineer, copy of which is hereto attached,
reveals that the structure erected on said land encroaches upon
the sidewalk alongthe southerly side of 15th Street in varying
degrees up to 0.1of a foot, and
WHEREAS, it is the opinion of the City Council that
the said encroachments were unintentional;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach, Florida that insofar as said City
Council has the power to b5.nd the City of Miami Beach in the
premises, no action of any kind whatsoever shall be taken by
the said City to require the owners of the said property or
their heirs, successors or assigns to move, or to remove, the
portion of the structures which now encroach upon said public
street as aforesaid.
